AGREEMENT NO. 2022-155
This AMENDMENT NO. 2 TO AGREEMENT NO. 2022-155 is made and entered into on ________________, by and between the CITY OF BAKERSFIELD, a municipal corporation (referred to herein as “CITY”), and HIGHSTREET IT SOLUTIONS, LLC a Corporation authorized to do business in California (referred to herein as “HIGHSTREET”).
R E C I T A L S
WHEREAS, CITY and HIGHSTREET entered into Agreement No. 2022-155 for software implementation and services; and
WHEREAS, on February 28, 2024, CITY and HIGHSTREET entered into Amendment No. 1 to Agreement No. 2022 -155 to implement a change order related to associated costs extending the project timeline and providing additional software environments and data conversion support; and
WHEREAS, CITY and HIGHSTREET desire to amend Agreement No. 2022 -155 a second time to implement a new change order to increase functionality and user licenses for the Enterprise Performance Management module for Oracle Financials and provide HIGHSTREET additional compensation.
NOW, THEREFORE, incorporating the foregoing recitals herein, CITY and HIGHSTREET mutually agree as follows:
1. Section 1 of Agreement No. 2022- 155 entitled “Scope of Work and Approach” is hereby amended to add Exhibit B, entitled “Change Order #7 to Statement of Work #1: Implementation Services” attached hereto and incorporated by reference herein which increases HIGHSTREET’s compensation in an amount not to exceed ONE HUNDRED FORTY-EIGHT THOUSAND SEVEN HUNDRED dollars
($148,700) for a total amount not to exceed FOUR MILLION SEVEN HUNDRED FORTY-NINE THOUSAND NINE HUNDRED FIFTY dollars
($4,749,950).
2. Except as amended herein, all provisions of Agreement No. 2022-155 shall remain in full force and effect.
