ADMINISTRATIVE REPORT

MEETING DATE: January 7, 2026 AGENDA CATEGORY: Consent - Resolutions TO: Honorable Mayor and City Council
FROM: Phillip Burns, Development Services Director
DATE: December 5, 2025
SUBJECT: Resolutions to add the following territories to the Consolidated Maintenance District and confirming, approving, and adopting the Public Works Director’s Report for each:

1. Area 5-144 (3501 Meeks Avenue): Street Tier = 0; Park Tier = 0 (Ward 1)

2. Area 4-319 (238 Dr. Martin Luther King, Jr. Boulevard): Street Tier = 2; Park Tier = 0.5 (Ward 2)

RECOMMENDATION:

Staff recommends adopting the resolutions.

BACKGROUND:

On December 17, 2025, the City Council adopted Resolutions of Intention No. 2250 and 2251 to add Areas 5-144 and 4-319, respectively, to the Consolidated Maintenance District as required by Section

13.04.021 of the Municipal Code. Inclusion in the Consolidated Maintenance District will provide for the maintenance of parks and/or street landscaping. For an area where a park has been constructed and/or street landscaping has already been installed, the area will be under the park and streetscape zones of benefit and will be assigned appropriate tier levels during the next annual update. For an area where a park and/or street landscaping has not been installed, the area will be assigned appropriate tier levels when improvements are constructed.

The addition of these areas to the Consolidated Maintenance District is not prohibited by Proposition 218.

The City of Bakersfield has received letters from the owners of the properties listed above which waives the public hearing concerning inclusion in the Consolidated Maintenance District. This allows the City to expedite the maintenance district process to satisfy subdivision requirements. The owners also have submitted a Proposition 218 ballot indicating consent to the assessment.

In order to provide future property owners with disclosure regarding the inclusion of land in the Consolidated Maintenance District and the estimated maximum annual cost per equivalent dwelling unit, a covenant has been drafted and will be recorded with the Kern County Assessor-Recorder’s Office upon approval of this resolution.

FISCAL IMPACT:

The revenue from Maintenance Assessment Districts partially supports ongoi ng maintenance in the districts for the year. There is some General Fund support on an annual basis for the short fall in the CMD revenue collected city-wide.

COUNCIL GOAL:

Reliable Infrastructure
