ADMINISTRATIVE REPORT

MEETING DATE: February 25, 2026 AGENDA CATEGORY: Consent - Agreements TO: Honorable Mayor and City Council
FROM: Phillip Burns, Development Services Director
DATE: February 6, 2026
SUBJECT: License Agreement with Castle and Cooke Commercial-CA for construction, maintenance, operation, inspection, repair, replacement, and removal of a storm drain pipeline at Young Street required for construction of Licensee’s Crossroads Plaza shopping center development. (Ward 5).

RECOMMENDATION:

Staff recommend approval of the License Agreement.

BACKGROUND:

Castle & Cooke Commercial-CA, Inc., developer of the Crossroads Plaza shopping center, has recorded Parcel Map 12514 and entered into Improvement Agreement No. 2024-247 with the City of Bakersfield for the construction of required public improvements. A key component of these improvements is the construction of a storm drain pipeline beneath Young Road, a public street. The pipeline will convey stormwater from the project site as well as adjacent public streets and will be privately maintained.

The improvement plans have been reviewed and approved by the City. As part of the final approval process for the project, including acceptance of Notices of Completion and issuance of a Certificate of Occupancy, authorization is required to allow the installation, operation, and maintenance of the storm drain facilities within City right-of-way. To facilitate this, the City has prepared a License Agreement to be executed between the City of Bakersfield and Castle & Cooke Commercial-CA, Inc., granting the necessary rights for the pipeline and requiring payment of a license fee.

The Development Services Department – Land Development has reviewed the License Agreement and recommends that the City Council approve the agreement. Approval represents a necessary step to satisfy project requirements and will allow the developer to proceed with final project closeout.

FISCAL IMPACT:

There will be no financial impact to the City. The proposed sewer line will be bonded for by the developer and they will pay all required fees to Union Pacific Railroad for processing this common use agreement.

COUNCIL GOAL:

Reliable Infrastructure
