ADMINISTRATIVE REPORT

MEETING DATE: March 11, 2026 AGENDA CATEGORY: Consent - Resolutions TO: Honorable Mayor and City Council
FROM: Virginia Gennaro, City Attorney
DATE: March 5, 2026
SUBJECT: Amendment No. 1 to Resolution No. 52-96 Authorizing the City Manager or his Designee or the Public Works Director or his Designee to Accept Certain Deeds or Grants Conveying an Interest in or Easement Upon Real Property for Public Purposes.

RECOMMENDATION:

Staff recommends approval of the Resolution.

BACKGROUND:

California Government Code Section 27281 provides that deeds or grants conveying any interest in or easement upon real property to a governmental agency for public purposes shall not be accepted for recordation without the consent of the governmental agency; and

California Government Code Section 27281 further provides a governmental agency may, by general resolution, authorize one or more officers or agents to accept and consent to such deeds or grants; and Section 12 of the Charter of the City of Bakersfield provides that the City may exercise any rights, powers, and privileges granted by the general laws of the State; and

On May 8, 1996, pursuant to Resolution No. 52 -96, the City Council authorized the Public Works Director or its designee to accept and consent to certain grants or deeds in an effort to achieve administrative efficiency; and

City Council desires to confirm that the authorization to accept and consent to deeds or grants expressly includes the City Manager or his designee, consistent with Bakersfield Municipal Code Section 1.04.010(B), as amended by Ordinance No. 5201. The requested change to clarify who can sign Grant Deeds, as this will allow for the City to move our processes faster for the development review and approval process. This is all part of our One Stop Shop efforts underway in the City.

FISCAL IMPACT:

This action will not result in additional costs from any fund, especially no costs from the General Fund.

COUNCIL GOAL:

Innovative and Efficient City Government
