RECOMMENDATION:
Staff recommends approval of the Amendment.
BACKGROUND: Since April 10, 2002, the Bakersfield Police Department (BPD) has partnered with Redflex Traffic Systems, Inc. to implement and operate a digital photo enforced red light camera system in the City of Bakersfield.
The agreement includes a Cost Neutrality provision that provides the City with a safeguard from being required to pay more than actual cash received. The not-to-exceed amount reflected in the Agreement is the flat -rate fee that the City pays per month, per approach, for operation of the red ligh t cameras.
However, the fees are offset by amounts collected from enforcement of the traffic violations. To date, the City has never paid more than the amounts collected (i.e., system has remained cost neutral).
On February 1, 2008, the BPD and Redflex Tr affic Systems, Inc. changed the business model of the agreement to comply with changes in the California Vehicle Code and subsequently entered into a second 5-year Agreement No. 08-015 with a term date of August 13, 2022. Under this agreement the city pai d for a monthly flat fee for each of the twelve existing approaches.
On August 31, 2022, the city and contractor entered into Agreement No. 2022-177 to increase the number of approaches with a not to exceed amount of $5,810,000 and a new term date of Au gust 31, 2027.
