SUBJECT: Resolution to Dispense with Bidding for Hornady Ammunition with MiWall Corporation
Resolution determining that Hornady Law Enforcement/Military Ammunition for exclusive use by Bakersfield Police Department, cannot be reasonably obtained through the usual bidding procedures and authorizing the Finance Director to dispense with bidding at not to exceed amount of $130,000.
RECOMMENDATION:
Staff recommend adoption of the resolution and approval of the purchase.
BACKGROUND: Hornady Law Enforcement/Military Ammunition, the manufacturer, has designated the only authorized Sole source law enforcement distributor for the State of California to be MiWall Corporation, therefore, staff is recommending adoption of the Resolution to d ispense with bidding for Law Enforcement/Military Ammunition and authorizing the purchase of said product from the sole supplier, MiWall Corporation on a continuing basis in amounts to meet the Police Department’s requirements.
The Bakersfield Police Department has standardized on Hornady Law Enforcement/Military ammunition needs. Hornady Law Enforcement/Military Ammunition is the standard product used by most law enforcement agencies. The Police Department desires to purchase products in larger quantities to maintain stock due to supply chain shortages and longer than normal shipping times.
On April 24, 2024, Council adopted Resolution No. 049-2024 to dispense with bidding procedures for the purchase of Hornady Law Enforcement/Military ammunition from MiW all Corporation in the amount of $130,000 in accordance with subsection D.2 of section 3.20.060 of the Bakersfield Municipal Code.
The Bakersfield Police Department desires to purchase additional Hornady Law Enforcement/Military ammunition in an amount n ot to exceed $130,000 per fiscal year pursuant to the same sole source Resolution No. 049-2024 previously approved by council.
FISCAL IMPACT:
Funds are available from a combination of General Fund, Public Safety Vital Services Measure Fund and Supplemental Law Enforcement Services Fund.
