ADMINISTRATIVE REPORT

MEETING DATE: March 25, 2026 AGENDA CATEGORY: Consent - Resolutions TO: Honorable Mayor and City Council
FROM: Phillip Burns, Development Services Director
DATE: March 4, 2026
SUBJECT: Resolution adding Area 4-322 to the Consolidated Maintenance District

Resolution to add the following territory to the Consolidated Maintenance District and approving, confirming, and adopting the Development Services Director’s Report:

Area 4-322 (304 Cypress Avenue): Street Tier = 0.5; Park Tier = 1 – Ward 2

RECOMMENDATION:

Staff recommends adopting the resolution.

BACKGROUND:

On March 11, 2026, the City Council adopted Resolution of Intention No 2255 to add Area 4-322 the Consolidated Maintenance District as required by Section 13.04.021 of the Municipal Code. Inclusion in the Consolidated Maintenance District will provide for the maintenance of parks and/or street landscaping.

The addition of this area to the Consolidated Maintenance District (CMD) is not prohibited by Proposition 218.

The City of Bakersfield has received a letter from the owner(s) of the property listed above which waives the public hearing concerning inclusion in the Consolidated Maintenance District. This allows the City to expedite the maintenance district process to satisfy subdivision requirements. The owner(s) also have submitted a Proposition 218 ballot indicating consent to the assessment.

In order to provide future property owners with disclosure regarding the inclusion of land in the Consolidated Maintenance District and the estimated maximum annual cost per equivalent dwelling unit, a covenant has been drafted and will be recorded with the Kern County Assessor-Recorder’s Office upon approval of this resolution.

FISCAL IMPACT:

The revenue from Maintenance Assessment Districts partially supports ongoing maintenance in the districts for the year. There is some General Fund support on an annual basis for the short fall in the CMD revenue collected city-wide.

COUNCIL GOAL:

Reliable Infrastructure
