MEETING DATE: April 8, 2026 AGENDA CATEGORY: Consent - Agreements TO: Honorable Mayor and City Council
FROM: Jennifer M. Byers, Economic & Community Development Director DATE: March 20, 2026
SUBJECT: Amendment No. 2 to Agreement No. 2024-304 with Community Action Partnership of Kern (CAPK) (increase ARPA grant funding $932,464.03) with for the Home Repair & Weatherization Program.
RECOMMENDATION:
Staff recommend approval of the amendment
BACKGROUND:
The City of Bakersfield was awarded Coronavirus State and Local Fiscal Recovery Funds (SLRF), a part of the American Rescue Plan Act (ARPA), to support the response to and recovery from the COVID-19 public health emergency.
On November 20, 2024, the City of Bakersfield City Council entered into Agreement No. 2024-304 with Community Action Partnership of Kern (CAPK) for implementation of the Home Repair and Weatherization Program (Program), using $700,000 in American Rescue Plan Act (ARPA) funding. Prior to engaging CAPK in services rendered for this Program, the city had entered into Agreement No. 2023- 007 with Staples Energy (terminated by Council on March, 25, 2026) under the same ARPA framework as they were unable to complete the Scope of Work.
ARPA funding is required to be spent within specific, approved categories as outlined in the Final Rule and funds can only be reclassified to programs within the same framework. The City proposes to reallocate the unexpended funding obligated to Staples Energy to CAPK. An additional $92,915.63 in funding will be added to the CAPK agreement which will revise total compensation not to exceed $932,464.03, which will be used to increase the volume of participants and associated costs for administration of the Program.
CAPK administers funds for residential improvements that assist homeowners and tenants make necessary health and safety repairs to their home.
FISCAL IMPACT:
The action to amend the agreement and provide additional funding does not include any use of General Funds, due to the lack of action on the part of previous contracted entity (Staple Energy). The allocation of unspent APRA will be reprogramed to CAPK as ARPA funds are Federal Allocations it will have no impact the General Fund.
COUNCIL GOAL:
Community Character & Quality of Life
Innovative and Efficient City Government
