ADMINISTRATIVE REPORT

MEETING DATE: May 27, 2026 AGENDA CATEGORY: Consent-Miscellaneous TO: Honorable Mayor and City Council
FROM: Zachary Meyer, Public Works Director
DATE: April 29, 2026
SUBJECT: Appropriate $400,000 from the Sewer Enterprise Fund (SEF) fund balance

into the Public Works Department’s Capital Improvements Program within the SEF fund for the Sewer Lift Station Rehabilitation at Hageman Road and Allen Road project. (Ward 4)

RECOMMENDATION:

Staff recommends the approval of the appropriation.

BACKGROUND:

The City of Bakersfield previously awarded a contract for the Sewer Lift Station Rehabilitation for Hageman Road and Allen Road to Nicholas Construction, Inc. (Contractor) . As part of that contract, the scope of work included a backup generator. At the time of the contract award, the generator met the requirements of the San Joaquin Valley Air Pollution Control District (SJVAPCD; District). However, when the Contractor applied for the permit for the generator , the City was told that the requirements h ad changed, and the City was not grandfathered ev en though the contract was awarded prior to the District requirement changes.

The City met with the District several times, but the District would not make an exemption for this project.

Therefore, the City has to upsize the generator to meet the District standards. The Contractor is giving the City a credit for the previously bid generator; however, there is still a significant cost increase for the new generator as there are additional requirements such as wiring, concrete, etc., so the generator can be in compliance and the permit to operate can be issued.

This appropriation would cover the costs of the change order, which is in the amount of approximately $334,000, and it would allow some additional monies to cover other contingencies and construction inspection costs. The lift station is nearly complete and operational, and the generator is the final piece to completing the entire project.

FISCAL IMPACT:

This appropriation is entirely funded with SEF; therefore, there is no general fund impact associated with this appropriation. Appropriation adjustments will also allow for sufficient funds to be made available for City-controlled contingencies, change orders and city inspection staff time.
