A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD A UTHORIZING THE ENCUMBRANCE OF
PROJECT PROPERTY TO PARTICIPATE IN THE BEHAVIORAL
HEALTH CONTINUUM OF CARE INFRASTRUCTURE
PROGRAM (“BHCIP”).
WHEREAS, the California Department of Health Care Services, through its contractor, Advocates for Human Potential, Inc. (“AHP” or “Department” herein), issued a Request for Applications dated July 15, 2024 (“RFA”), for the BHCIP Round 1 (2024) Launch Ready Program (“Program”). The Department has issued the RFA for Program grant funds pursuant to California Welfare and Institutions Code sections 5965-5967.01 (“Behavioral Health Infrastructure Bond Act of 2024”); and
WHEREAS, on October 7, 2024, the City of Bakersfield (“Applicant” herein), a charter city and municipal corporation, applied for Program grant funds by submitting an application to the Department for review and consideration; and WHEREAS, on May 6, 2025, the Applicant was conditionally awarded $22,867,345 in Behavioral Health Continuum of Care Infrastructure Program (BHCIP) grant funds from California Department of Health Care Services, through its contractor, Advocates for Human Potential, Inc.; and
WHEREAS, the Department is authorized to administer BHCIP pursuant to California Welfare and Institutions Code Section 5960-5960.4, as amended by the Behavioral Health Infrastructure Bond Act of 2024. Program funding allocations are subject to the terms and conditions of the RFA, the Application, the Program Funding Agreement between Applicant and AHP (“Program Funding Agreement” herein), and all other legal requirements of the Program; and
WHEREAS, Applicant desires to authorize the Department to encumber the real property located at 2310 Wible Road, Bakersfield, CA 93304 (“Project Property” herein), as more particularly described in the Program Funding Agreement, by recording a Declaration of Restrictions, as required for the release of Program grant funds to Applicant, pursuant to the Program requirements.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows:
1. Department is authorized and directed to administer BHCIP pursuant to California Welfare and Institutions Code Section 5960-5960.4, as amended by the Behavioral Health Infrastructure Bond Act of 2024. Program funding allocations are subject to the terms and conditions of the RFA, the

Application, the Program Funding Agreement between Applicant and AHP, and all other legal requirements of the Program.
2. Applicant acknowledges and agrees that it shall be subject to the terms and conditions specified in the Program Funding Agreement. Any and all activities, expenditures, and information represented in the Application are enforceable through the Program Funding Agreement. Funds are to be used for the allowable expenditures and activities identified in the Program Funding Agreement.
3. The Mayor or designee is authorized to execute the Declaration of Restrictions to be recorded against the Project Property in the official records where the Project Property is located prior to the Department disbursing Program grant funds to Applicant.
