DATE: May 18, 2026
SUBJECT: Amendment 6 to Agreement No. 2022-183 with Critters without Litters, Inc. ($220,000; for a not to exceed amount of $1,050,000 and to extend the term of the agreement to June 30, 2027) to provide for cat spay, neuter, and vaccination services for the City's Community Cat Program.
RECOMMENDATION:
Staff recommends approval of this amendment.
BACKGROUND: During FY 2022, Critters Without Litters (CWOL) contracted with the City to implement the City's first pilot Community Cat program. At the time, the City's Animal Care Center did not have an on-site veterinarian that can provide these services. The program showed success in reducing the City’s feral cat population. As a result, a Request for Propo sals to continue the program was issued and responses were due July 29, 2022. CWOL was the only responsive bidder. CWOL is a local nonprofit 501c (3) organization that provides high -volume, high-quality, subsidized companion animal sterilization and seeks to end the preventable euthanasia of healthy, adoptable pets in Kern County. Critters Without Litters aims to directly address the issue through high -volume, low cost spays and neuter services with the aim of reducing the number of companion animals entering shelters.
On August 31, 2022, the City of Bakersfield entered into Agreement No. 2022 -183 with CWOL for an amount not to exceed $180,000 and a term date of June 30, 2023, to provide for cat spay, neuter, and vaccination services for the City's Community Cat Program.
On June 28, 2023, City entered into Amendment 1 to Agreement No. 2022-183 with CWOL and increased compensation by $30,000 for a new total not to exceed $210,000 and a term date of June 30, 2024, to continue spay and neuter, and vaccination services
On August 9, 2023, Amendment 1 to Agreement No. 2022 -183 added an insufficient amount of funds to cover the full year of expenses related to the spay and neuter program. Due to the insufficient funding approved in the previous amendment, the C ity entered into Amendment 2 to Agreement No. 2022 -183 and increased the compensation by $180,000 for a total not to exceed amount of $390,000 and a new term date of June 30, 2024.
On June 26, 2024, City entered into Amendment 3 to Agreement No. 2022-183 with CWOL and increased compensation by $220,000 for a total not to exceed amount of $610,000.
Due to an inadvertent error On July 24, 2024, the city entered in the fourth amendment to extend the term of the agreement to June 30, 2025, to continue spay and neuter services.
On June 25, 2025, City entered into Amendment 5 to Agreement No. 2022-183 with CWOL and increased the compensation by $220,000 for a new not to exceed amount of $830,000.
The City now desires to amend Agreement No. 2022 -183 for a sixth time to increase compensation by $220,000 for new not to exceed amount of $,1,050,000 and extend the term of the agreement to June 30, 2027, to continue spay and neuter services.
