SUBJECT: License Agreement with North Kern Water Storage District, BN Bakersfield 1, LP, for Tract 7093 Phase 3.
($6,000) to allow the construction of a storm drain line over an existing canal (Ward 4).
RECOMMENDATION:
Staff recommend approval of the License Agreement.
BACKGROUND:
BN Bakersfield, LP will be entering into an improvement agreement with the City of Bakersfield for the construction of public improvements associated with Tract 7093 Phase 3. A key part of these improvements is the construction of a storm drain line that will be taking drainage from Olive Drive and crossing over North Kern District’s R-0 Canal to reach a sump on the other side. Once completed, the public improvements will be maintained by the City of Bakersfield.
The improvement plans have been reviewed and approved by both the City and North Kern Water Storage District. In order to move forward with construction, the developer must obtain final permission from North Kern Water Storage District. To address this, North Kern Water Storage District and the City have prepared a license agreement, which must be executed between the City, North Kern Water Storage District, and BN Bakersfield, LP to allow the storm drain line to be built across the canal.
The Development Services Department has reviewed the license agreement and is recommending that the City Council approve the license agreement. This is the final step needed to comply with project requirements and allow the developer to proceed with construction of the improvements.
FISCAL IMPACT:
There will be n o financial impact to the City. The proposed storm drain line will be bonded for by the developer and they will pay all required fees to North Kern Water Storage District for processing this license agreement.
