SUBJECT: Quitclaim agreement with Calloway North Investors, LLC for purchase of easement

RECOMMENDATION:
Staff recommend approval of the agreement.
BACKGROUND:
On February 13, 1959, Gregorio and Eulalia Mendiburu granted to the Kern River Canal and Irrigating (KRC&I) Company, a pipeline easement granting KRC&I Company the right to lay and operate a water pipeline beneath their property (the “Easement”). On December 22, 1976, City acq uired the Easement along with its pre-1914 water rights and much of its current water infrastructure.
Calloway North Investors, LLC has determined a need to acquire the Easement.
City Staff have determined that, for City purposes, the Easement is no l onger necessary. As such, City Staff negotiated an agreement with Calloway North Investors, LLC, whereby the LLC will purchase the Easement from City for nominal consideration.
FISCAL IMPACT:
There is no fiscal impact to the City’s General Fund associated with the approval of this agreement.
