FROM: Phillip Burns, Development Services Director
DATE: July 15, 2026
SUBJECT: Amendments to ARPA Agreements with Willdan Engineering and Community Action Partnership of Kern
1. Amendment No. 1 to Agreement No. 2024-309 with Willdan Engineering (reducing compensation from $400,000 to $240,000) to identify non-permitted Accessory Dwelling Units (ADUs) and assist households in bringing these structures into compliance; and
2. Amendment No. 3 to Agreement 2024-304 with Community Action Partnership of Kern (increasing compensation by $160,000) for implementation of the Home Repair and Weatherization Program
RECOMMENDATION:
Staff recommends approval of the amendments.
BACKGROUND:
On November 20, 2024, the City entered into Agreement No. 2024-309 with Willdan Engineering, allocating $400,000 in American Rescue Plan Act (ARPA) funding for the identification of non-permitted Accessory Dwelling Units (ADUs) within the city limits and connection of those households with services to permit those structures.
At the same meeting, the Bakersfield City Council approved Agreement No. 2024-304 with Community Action Partnership of Kern (CAPK), allocating $700,000 in ARPA funds for the implementation of the City’s Home Repair and Weatherization Program.
Willdan Engineering is unable to utilize its full allocation within the agreement term. To prevent the loss of unspent funds, the City proposes reallocating $160,000 originally obligated to Willdan to the Community Action Partnership of Kern, thereby decreasing Willdan’s allocation to $240,000 and increasing the total funding allocated to CAPK to $1,092,464.03.
This reallocation complies with the U.S. Department of the Treasury ARPA guidelines, which allows funds to be reassigned between programs within the same eligible category.
FISCAL IMPACT:
The allocation of unspent funding will be reprogrammed to CAPK as ARPA funds are federal allocations and will have no impact on the General Fund.
COUNCIL GOAL:
Community Character & Quality of Life
