ADMINISTRATIVE REPORT

MEETING DATE: September 16, 2026 AGENDA CATEGORY: Consent - Agreements TO: Honorable Mayor and City Council
FROM: Phillip W. Burns, Development Services Director
DATE: August 28, 2026
SUBJECT: Common Use Agreement between the City of Bakersfield and Pacific Gas & Electric Company for construction over existing pipeline within Tract 6880 Phase 2.

The City of Bakersfield is requesting to enter into a common use agreement with Pacific Gas & Electric Company to allow the construction of a road over an existing large high-pressure gas pipeline within proposed Tract 6880 Phase 2 (Ward 5).

RECOMMENDATION:

Staff recommend approval of the Common Use Agreement.

BACKGROUND:

Millrose Properties California, LLC, will be entering into an improvement agreement with the City of Bakersfield for the construction of public improvements associated with Tract 6880 Phase 2. A key part of these improvements is the construction of Blackwater Valley Drive, which will cross over an existing large high-pressure gas pipeline owned by Pacific Gas & Electric Company (PG&E). Once completed, the public improvements will be maintained by the City of Bakersfield.

The improvement plans have been reviewed and approved by both the City and PG&E. In order to move forward with construction, the developer must obtain final permission from PG&E. To address this, PG&E has prepared a Consent to common use agreement, which must be executed between the City and PG&E to allow the roadway to be built across their pipeline.

The Development Services Department has reviewed the common use agreement and is recommending that the City Council approve the Consent to common use agreement. This is the final step needed to comply with project requirements and allow the developer to proceed with construction of the improvements.

FISCAL IMPACT:

There will be no financial impact to the City. The proposed sewer line will be bonded for by the developer and they will pay all required fees to Union Pacific Railroad for processing this common use agreement.

COUNCIL GOAL:

Reliable Infrastructure
