ADMINISTRATIVE REPORT
MEETING DATE: September 16, 2026 AGENDA CATEGORY: Consent - Resolutions TO: Honorable Mayor and City Council
FROM: Phillip Burns, Development Services Director
DATE: August 26, 2026
SUBJECT: Resolution of Intention No. 2284 to add Area 5 -149 to the Consolidated Maintenance District.
Resolution of Intention (ROI) to add the following territory to the Consolidated Maintenance District and preliminarily approving, confirming, and adopting the Development Services Director’s Report:
ROI No. 2284 adding Area 5-149 (Tract 7153 – north side of E. Wilson Road, east of S. Fairfax Road):
Street Tier = 1; Park Tier = 0 – Ward 1
RECOMMENDATION:
Staff recommends adopting the resolution of intention.
BACKGROUND:
Written requests have been received by the City Engineer from the owner of the parcel to be included in the Consolidated Maintenance District as required by section 13.04.021 of the Municipal Code. Inclusion in the Consolidated Maintenance District will provide for the maintenance of parks and/or street landscaping.
The City of Bakersfield has received a letter from the owner of the property listed above which waived the public hearing concerning inclusion in the Consolidated Maintenance District. This allows the City to expedite the maintenance district process to satisfy subdivision requirements. The owner has also submitted a Proposition 218 ballot indicating their consent to the assessments.
To provide future property owners with disclosure regarding the inclusion of land in the Consolidated Maintenance District and the estimated maximum annual cost per equivalent dwelling unit, a covenant has been drafted and will be recorded with the Kern County Assessor‐Recorder's Office upon approval of this Resolution.
Staff recommend the new territory be added to the Consolidated Maintenance District at the next City Council meeting.
FISCAL IMPACT:
The revenue from Maintenance Assessment Districts partially supports ongoing maintenance in the districts for the year. There is some General Fund support on an annual basis for the short fall in the CMD revenue collected citywide.
COUNCIL GOAL:
Reliable Infrastructure
