Cost Transparency
• Owner control of the budget
through every phase of the project
• Final price determined before
construction
• Owner must agree with

schedule before project
moves into construction
Where does the legal authority come from?

What if we don’t agree on a price with the PDB?
The Off-Ramp
• Key Contract clause for Progressive Design-Build.
• At the City’s sole discretion, forgoes the construction phase. • City will complete the design through the PDB’s engineering firm. • City bids the project traditionally.
Creates incentive
for the Design-Builder
to achieve an agreeable GMP.
Downside for the Owner:
taking the off-ramp can delay construction while project design is completed, bid package developed and public bids received.
Off-ramp is a contractually
defined option for the City of
Banning to use that
terminates the project
agreement prior to NTP for
Phase 2. Off-ramp taken
when the City and PDB are
unable to agree on a price for
Phase 2.
