Background
• On July 13, 2022, the Planning Commission adopted Resolution 2022-10 approving a Conditional Use Permit to allow a market and deli store selling beer, wine and distilled spirits within an existing building located at 263 W. Ramsey • Since that time, the City has issued permits to allow improvements to the building for the market and deli
• The operator, Grapevine Liquor, has submitted an application to the Dept. of Alcoholic Beverage Control (ABC) to sell beer, wine and distilled spirits for off- site consumption – a Type 21 liquor license Liquor License Process
• The ABC processes licenses pursuant to California Business and Professions Code (BPC)
• BPC Section 23958 requires the ABC to deny a liquor license if proposed within a census tract that has an undue concentration of licenses • An undue concentration exists when the ratio of retail licenses to the population in a census tract exceeds the ratio of licenses to population in the county • BPC Section 23958.4(b) allows the issuance of an additional license within a census tract having an undue concentration if the governing body (City Council) determines a public convenience or necessity (PCN) would be served by the issuance of the additional license

• The subject site is located within census tract 441.01, which is encompassed by Sunset Avenue to the west, San Gorgonio Avenue to the east, Nicolet Street to the north and Interstate 10 to the south • There are currently 12 retail licenses within tract 441.01, including Type 21 (Off-Sale General) and Type 20 (Off-Sale Beer & Wine) • The Applicant’s would be the thirteenth within this census tract Census Tract and Existing Licenses

Evidence Supporting PCN • Site is within Downtown Commercial Zone, an area where typically more liquor licenses are concentrated to attract residents and tourists visiting retail, service, and entertainment uses. The proposed business will provide market and deli food, in addition to liquor sales, and increase retail options in the City, and be consistent with the General Plan policies, including:
• Policy 4: Attract a greater number of commercial retail businesses to the Downtown Core area to develop a safe, vital and consumer-friendly downtown shopping area. Program • 4.A: Provisions for the Downtown Commercial Zoning District shall encourage specialty retail uses, livework uses, and other uses which support and expand the pedestrian and tourist-related shopping experience
• The Planning Commission issued a Conditional Use Permit for the proposed use on July 13, 2022, which included findings that the use is consistent with criteria in Section 17.52.050 of the Zoning Code. The Commission found the use was consistent with the General Plan and Zoning Code; the use would not impair the integrity and character of the land use district; the site is physically suitable for the type and intensity of land use being proposed, among other findings necessary for approval of the CUP.

• Sun Lakes Boulevard right of way was offered to the City of Banning on Parcel Map 25541 in February 1990

• Pass Zone is Banning, Beaumont, Calimesa, and County or Riverside • Approximately 45.7% of all funds collected in the Zone remain for projects in the Zone.
• SLB is identified as a qualifying project on the Secondary (Zone Specific) Network
• 2017 TUMF MAX Share is $17,659,000

This is a letter of concern regarding the homeless animals in our city. I am respectfuUy requesting that we DO NOT spend any of our money on a contract with ANY kill shelter, county or otherwise.
We citizens want a speedy resolution of this issue by opening a NO KILL shelter in our city.
