The following information comprises the minutes for the special meeting of the Banning City Council, a joint meeting of the City Council and Banning Utility Authority, and the Banning City Council sitting in its capacity as the Banning Successor Agency Board.
1. CALL TO ORDER

3.1 CONFERENCE WITH LEGAL COUNSEL-EXISTING LITIGATION
Pursuant to Government Code Section 54956.9(d)(1) - Three (3) Cases
1. Sun Lakes Highlands v. City of Banning et.al Case No. 5:24-Cv-02603-dtb
2. Workers Compensation Case No. 1080-WC-22-0000019, Michael Loader.
3. Two Brothers 14 Corporation Inc v. City of Banning et.al Case No. CVR12406468
3.2 CONFERENCE WITH LEGAL COUNSEL-ANTICIPATED LITIGATION Pursuant to Government Code Sections 54956.9(d)(2), (3) and/or (4). Two potential cases.
3.3 PUBLIC EMPLOYMENT/EMPLOYEE APPOINTMENT
Pursuant to Government Code Section 54957. Title: City Manager.
The City Council recessed into Closed Session at 5:01 p.m.
Mayor Flynn recused herself from item 3.1.1 because she was personally named on this lawsuit.
Art Vela, Interim City Manager recused himself from item 3.3. 2 The City Council reconvened in open session at 8:27 p.m.
City Attorney reported on the Closed Session items as follows:
• Item 3.1 - Conference with Legal Counsel – Existing Litigation (Three Cases): No reportable action taken.
• Item 3.2 Conference with Legal Counsel – Anticipated Litigation (Two Potential Cases): No reportable action taken.
• Item 3.3 – Public Employment/Employee Appointment – City Manager: No reportable action taken.
4. ADJOURNMENT
A motion to adjourn the meeting was made by Mayor Pro Tem Royce, seconded by Council Member Miller. Motion carried unanimously 5-0, and the meeting was adjourned at 8:27 p.m.
