Frank Connolly expressed opposition to the pending litigation filed by City Treasurer Gladys ‘Sue’ Savage and urged the City to vigorously defend the action and seek recovery of its legal costs.

Agency Negotiator: City Manager Elizabeth Gibbs or her designee. Negotiating Parties: City of Banning as potential Lessor and Industrial Enterprises, LLC as potential Lessee. Under Negotiations:
Price and terms of proposed ground lease.
Council Member Flynn and Council Member Wallace were not present during item 3.1 (one case) due to a conflict of interest.
City Manager Gibbs stated she would recuse herself from Item 3.2 because the matter involved her and noted that she had left the room during public comments concerning that item.
Council Members recessed to Closed Session at 3:07 p.m. to discuss the items listed.
The City Council reconvened in open session at 9:11 p.m., Council Member Flynn absent.
CLOSED SESSION REPORT
Assistant City Attorney Norton reported that there was no reportable action on Items 3.1 through
3.4. 4. ADJOURNMENT
MOTION
Council Member Wallace moved and Council Member Miller seconded a motion to adjourn the meeting. The question was called and the motion carried 4-0-1, Council Member Flynn absent.
The meeting adjourned at 9:13 p.m.
