AUTHORIZING THE APPOINTMENT OF GEORGE CRUM, A CALPERS RETIRED

ANNUITANT, TO TEMPORARILY PERFORM THE DUTIES OF CHIEF OF POLICE DURING

AN APPROVED LEAVE OF ABSENCE, PURSUANT TO GOVERNMENT CODE SECTIONS 7522.56 AND 21221(g)
WHEREAS, Government Code section 21221(g) permits a CalPERS contracting agency to appoint a retired person to temporarily fill a position held by a permanent employee who is on an approved leave of absence, for a period not to exceed one year, subject to the post-retirement employment restrictions of Government Code section 7522.56; and WHEREAS, the permanent Chief of Police of the City of Banning is on approved leave of absence for an unknown period of time (not to exceed one year); and WHEREAS, the position of Chief of Police requires specialized skills, including law enforcement executive command experience, knowledge of police department administration and operations, and the qualifications required by the Commission on Peace Officer Standards and Training (POST), and the City requires these skills on a temporary basis to prevent a disruption of public safety services during the leave of absence; and WHEREAS, George Crum retired from the California Public Employees' Retirement System (CalPERS), effective December 18, 2025, from the position of Police Chief, and possesses the specialized skills required to temporarily perform the duties of Chief of Police; and WHEREAS, the City Manager has extended a conditional offer of employment to George Crum as a retired annuitant to perform the duties of Chief of Police, with an anticipated start date of October 26, 2026, contingent upon satisfactory completion of a background investigation as required by POST, a pre-employment physical examination, psychiatric examination, and confirmation that all CalPERS post-retirement employment requirements have been satisfied; and WHEREAS, the City Council desires to appoint George Crum, a retired annuitant, to temporarily perform the duties of Chief of Police during the current Police Chief's leave of absence, pursuant to and in compliance with Government Code sections 7522.56 and 21221(g).

NOW, THEREFORE, BE IT RESOLVED, the City Council hereby certifies the nature of the employment of George Crum as described herein and detailed in the attached employment agreement/contract/appointment document and that this appointment is necessary to fill the critically needed position of Police Chief for the City of Banning by October 26, 2026, because the need for executive-level support continues to exist while the current Police Chief is on an approved leave of absence.

CITY OF BANNING

STAFF REPORT
TO: CITY COUNCIL
FROM: Elizabeth Gibbs, City Manager
PREPARED BY: Elizabeth Gibbs, City Manager
MEETING DATE: October 13, 2026
SUBJECT: Resolution 2026-137 Adopting Policies for the Budget and Finance Committee and Expanding its Membership to Include Members of the Public
STAFF RECOMMENDATION:

Adopt Resolution 2026-137
BACKGROUND:

The Budget and Finance Committee was formed in January 2014, when the City Council approved its annual committee assignments. The committee did not appear on the 2013 assignment list. It was established as one of the Council's "2x2 Council Working Groups," with initial appointments of two Council Members and the City Treasurer. At that meeting, the Council also discussed that committees would meet quarterly unless otherwise stated and that staff would develop a meeting calendar so the public would know when committees meet. No focus, scope, or membership rules were adopted for the committee at that time.

In January 2023, the City Council directed the City Manager to develop policies for its standing committees. On April 25, 2023, Mayor Pro Tem Wallace requested policies specific to the Budget and Finance Committee. On May 9, 2023, staff presented proposed Resolution 2023-81, which would have approved City Council Standing Committee Policies for the Council's six standing committees (Attachment 1). The City Council did not adopt Resolution 2023-81. As a result, the City has not adopted policies governing the focus, responsibilities, procedures, or membership of the Budget and Finance Committee or its other standing committees.

The May 9, 2023 staff report noted that the Budget and Finance Committee was the most active committee, and that the lack of written guidance had led to requests that departed from the committee's original intent, including an attempt to direct the Administrative Services Director. The proposed policies would have addressed this by establishing that committees are advisory, work only on matters assigned by the City Council, and have no authority to direct staff, adopt policy, or obligate the City. They would also have defined the Budget and Finance Committee's focus and responsibilities in five areas: Budget, Compliance, External Audit, Asset Management, and Oversight.

The 2023 draft also did not address committee membership, qualifications, terms of service, or participation by members of the public. The committee continues to be made up only of two Council Members and the City Treasurer, and it still operates without written guidance on its scope or procedures.

The City's circumstances have changed significantly since 2023. On February 24, 2026, the City Council 845
adopted a Strategic Plan that makes Banning's Workout Plan to Fiscal Sustainability a top priority. On June 9, 2026, the City Council adopted continuing Resolution 2026-89 to authorize expenditures while the budget was completed, and on June 23, 2026, the City Council declared a fiscal emergency through Resolution 2026-102. The City held public budget workshops on August 18, August 20, August 26, and September 10, 2026, and the City Council adopted the FY 2026-27 budget on September 21, 2026.

During the same period, the Riverside County Civil Grand Jury issued its report, "Banning: A City Alarmingly Mismanaged," and the City submitted its formal response. The FY 2025 audit is nearing completion, and the FY 2026 audit is expected to begin before the end of calendar year 2026.

At the September 22, 2026, City Council meeting, Mayor Royce requested that the City Council consider expanding the Budget and Finance Committee to include members of the public. This report responds to that request. Because the 2023 policies were never adopted, it uses the 2023 draft as a starting point for Budget and Finance Committee policies, and adds provisions for public members.

JUSTIFICATION:

The City is asking residents to understand and support difficult financial decisions under a declared fiscal emergency. Adding qualified members of the public to the Budget and Finance Committee would give residents a direct, ongoing role in reviewing the City's finances in furtherance of direct public oversight.

Staff has identified the following reasons to support the change:

1. Transparency and public trust - Following a fiscal emergency declaration and the Grand Jury report, residents have reason to want independent eyes on the City's finances. Public members who are not elected and not employed by the City provide that independent perspective in a public, Brown Act-noticed setting.

2. Added expertise at no cost - Banning residents with backgrounds in accounting, auditing, public finance, banking, or utility rates can add technical capacity while the Finance Department continues to rebuild and clean up the City's books.

3. Continuity through a multi-year recovery - Council committee assignments can change every year.

Public members serving staggered two-year terms would provide continuity across the multi-year Workout Plan, the audits, and future budget cycles.

4. Stronger audit oversight - Under the proposed policies, the committee would review audit results.

The Government Finance Officers Association (GFOA) recommends that governments maintain an audit committee whose members, collectively, have expertise in accounting, auditing, and financial reporting and are independent of management. Qualified public members help the committee meet that standard.

5. Puts written guardrails in place for the first time - Because Resolution 2023-81 was not adopted, the committee has no written scope or procedures today. The proposed policies would establish that the committee is advisory, works only on matters assigned by the City Council, and may not direct staff. This gives public members clear rules from their first meeting.

6. Timing - If the City Council provides direction now, public members could be appointed in December 2026 and participate in the FY 2027-28 budget and FY 2026 audit process.

Staff proposes the following framework for the committee:

1. Number of committee members - Two Council Members appointed annually by the Mayor; City Treasurer; and two at large residents of the city of Banning.

2. Eligibility - Banning residents, 18 years or older. NOT eligible - City employees; family members of Council; the City Manager or Finance Department staff; owners, officers, or employees of businesses with active City contracts; employees of the City's external audit firm; and members or family members of another City board, commission, or committee.

3. Desired qualifications - experience in accounting, auditing, public or municipal finance, budgeting, banking, investments, or utility finance. A CPA, CPFO, CIA, or similar credentials is preferred but not required.
846

4. Appointment process - City Clerk posts vacancies for at least 30 days. Applications are presented to City Council at a workshop. Interviews of the applicants are held in a publicly noticed meeting.

City Council appoints the two residents at the regular meeting following the workshop.

5. Terms - Two-year staggered terms, with a limit of two consecutive full terms. For the first appointments, one seat is a one-year term, chosen by the Council.

6. Chair and Vice Chair - Chair is a Council Member of the committee. Vice Chair is elected annually by the committee from among its members.

7. Compensation - None.

8. Attendance and removal - Members serve at the pleasure of the City Council and may be removed by majority vote of the City Council. Three consecutive unexcused absences, or missing one-third of meetings in a 12-month period, creates an immediate vacancy.

9. Training - Brown Act and ethics training, and an orientation on the City's budget and finances by the Finance Director, within 60 days of appointment.

Proposed Implementation Timeline
October 13, 2026 - Council adopts resolution
October 14, 2026 - City Clerk posts notice of vacancies; application period open for at least 30 days December 8, 2026 - Council interviews and appointments
December 15, 2026 - first Budget and Finance Committee meeting FISCAL IMPACT:

There is no direct fiscal impact from providing direction. Under the staff proposal, public members would serve without compensation. Costs would be limited to staff time for recruitment, public noticing, agenda preparation, minutes, Form 700 administration (if required), and member orientation. These costs would be absorbed within the adopted FY 2027 budget.

CITY OF BANNING

STAFF REPORT
TO: CITY COUNCIL
FROM: Elizabeth Gibbs, City Manager
PREPARED BY: Paul Mattern, Transit Manager
Art Vela, Director of Public Works
MEETING DATE: October 13, 2026
SUBJECT: Consideration of Resolution 2026-120, Approving a Transit Service Funding Agreement between the City of Banning and the County of Riverside for the Continued Provision of Fixed-Route Transit Service to the Cabazon Area
STAFF RECOMMENDATION:

Adopt Resolution 2026-120
BACKGROUND:

The City of Banning, through it's transit system "Banning Connect", currently operates fixed-route public transit service within the unincorporated community of Cabazon. The service provides Cabazon residents with access to public transportation and regional connections to employment, shopping, healthcare, education, and other essential services. The City of Banning and County of Riverside have identified a shared interest in maintaining public transportation access for residents of Cabazon and coordinating transit service between the jurisdictions. The proposed Transit Service Funding Agreement provides a framework for the City and County to coordinate route planning, schedules, stops, transfers, fare policies, and the dissemination of transit information.

Under the proposed agreement, the City will continue providing fixed-route transit service within the Cabazon area. In support of this service, the County will provide Cabazon Revitalization Funding to the City in an amount not to exceed $90,000 over a three-year period, consisting of annual payments of $30,000. This funding would cover the City's local costs for providing the service to the Cabazon area.

The agreement will remain in effect for three years unless terminated earlier in accordance with its provisions. The agreement also provides for annual coordination between the City and County to discuss transit services for the following fiscal year.

JUSTIFICATION:

Continuation of Banning Connect fixed-route service to Cabazon provides an important transportation connection for residents of the unincorporated community and supports access to employment, healthcare, shopping, education, and other essential destinations.

Because the service extends beyond the City of Banning's jurisdictional boundaries and provides a direct benefit to residents of unincorporated Riverside County, the proposed agreement establishes a cooperative funding arrangement between the City and County. The County's financial contribution recognizes the regional benefit of the service and offsets a portion of the City's costs associated with operating transit service within Cabazon.
858
The agreement also formalizes coordination between the agencies regarding route planning, schedules, stops, transfers, fare policies, and passenger information, helping ensure that service provided within Cabazon remains responsive to the transportation needs of the community.

Approval of the Transit Service Funding Agreement will allow the City to continue providing fixed-route transit service to Cabazon while receiving financial participation from Riverside County to support the service. Staff recommends approval of the agreement to maintain this regional transportation connection and continue the City's partnership with Riverside County.

FISCAL IMPACT:

Under the proposed Transit Service Funding Agreement, Riverside County will provide the City of Banning with an amount not to exceed $90,000 over the three-year term of the agreement, consisting of three annual payments of $30,000, that shall be paid by June 30 of each year starting with June 30, 2026. Funding will be provided through the County's Cabazon Revitalization Funding program.

The County's contribution will provide revenue to the City's Transit Fund to offset a portion (City's local match) of the operating costs associated with providing fixed-route transit service within the Cabazon area. The Transit Fund is an independent fund from the General Fund. Approving the agreement has no impact on the City's General Fund.

CITY OF BANNING

STAFF REPORT
TO: CITY COUNCIL
FROM: Elizabeth Gibbs, City Manager
PREPARED BY: Lisa Rossi, Human Resources Director
MEETING DATE: October 13, 2026
SUBJECT:

Consideration of Resolution 2026-142, Amending the City of Banning's Classification and Compensation Plan
STAFF RECOMMENDATION:

Adopt Resolution 2026-142
BACKGROUND:

Classification & Compensation Plan
The City must amend its Classification & Compensation Plan periodically to keep it current and reflect budget amendments, organizational structure, and departmental needs.

Past City Council resolutions have identified the necessity to maintain a current Classification & Compensation Plan that reflects the nature of work and organizational structure, and that the plan is updated to reflect both market changes and appropriate compensation for work performed.

Proposed changes to the Classification and Compensation Plan include:

On September 22, 2026, the City Council adopted the City's budget, which approved changes to the City's organizational structure and staffing. The Classification and Compensation Plan must now be amended to match those approved changes. In preparing this amendment, staff reviewed the City's executive and management classifications to confirm that position titles, duties, and salary ranges match the organizational structure approved in the budget. The reclassifications below implement the Council's budget direction by adding executive-level support to the City Manager's Office, consolidating engineering, development review, and permitting under one department, and better describing the broader range of community programs the City provides. Each reclassified position will be placed on the salary schedule at a range consistent with its level of responsibility, and all ranges will be shown on the City's publicly available pay schedule in compliance with CalPERS requirements. The proposed changes are as follows:

Reclassify the Public Works Director position (Range D12) to an Assistant City Manager (Range 868
D12.) The City Manager’s Office needs an administrative-level position to assist the City Manager.

Reclassify the Deputy Public Works Director/ City Engineer position (Range T104) to a Development Services Director (Range D08.)
Reclassify the Parks and Recreation Director position (Range D01) to a Community Services Director (Range D01.)
JUSTIFICATION:

The City is updating its salary schedule presentation so that all reported compensation complies with the plain reading of the applicable statutes and regulations under the Public Employees’ Retirement Law (PERL). CalPERS has a duty to correct any mistakes, errors or omissions whether it was completed by the employer, the member or even CalPERS. Once identified, CalPERS is prohibited from allowing a mistake, error or omission to continue. Our objective in presenting the salary schedule is to ensure consistency and legal compliance, increase transparency, and minimize the risk of audit findings, subsequent corrections, and overpayment of benefits.

STAFF REPORT
TO: CITY COUNCIL
FROM: Elizabeth Gibbs, City Manager
PREPARED BY: Jennifer Terry, Finance Director
Jennifer Terry, Finance Director
MEETING DATE: October 13, 2026
SUBJECT: Adoption of the Fiscal Year 2026-2027 Operating Budget for the Electric Utility Public Benefit Fund 675
STAFF RECOMMENDATION:

Adopt Resolution No. 2026-143 Approving the Fiscal Year 2026-2027 Operating Budget for the Electric Utility Public Benefit Fund (Fund 675), effective retroactively to October 1, 2026.

BACKGROUND:

The City's Fiscal Year 2026-2027 began on July 1, 2026. The City Council adopted Resolution 2026-89, authorizing continued expenditures through September 30, 2026, pending adoption of the Fiscal Year 2026-27 budget.

On September 22, 2026, staff presented the Operating Budget to City Council for approval. Staff needed additional time to review the fund's projected resources and proposed expenditures applicable to the Public Benefit Fund program. City Council approved Joint Resolutions 2026-131, 2026-08UA, and 2026- 02 SA, adopting the Operating Budget, excluding the Public Benefit Fund.

Fund 675 accounts for revenues and expenditures associated with the Electric Utility's public benefit programs. Fund resources are to be used for eligible public benefit purposes and administered in accordance with applicable requirements.

Staff reviewed the proposed budget and determined that the amounts and uses reflected in the attached Fund 675 budget schedule are appropriate for Council consideration. No changes were made to the revenue or expenditure accounts from what was originally presented for adoption. Adoption will establish expenditure authority for the remainder of the fiscal year, allow staff to administer the fund's programs, and ensure that Fund 675 transactions recorded beginning October 1 are applied against Councilapproved appropriations.

Staff recommends that the budget take effect retroactively on October 1, 2026. This date marks the 892
beginning of the second quarter and follows the first-quarter continuing budget period. The retroactive effective date avoids a gap in budget authority after September 30 and supports consistent accounting for Fund 675 activity beginning October 1.

Approval of the operating budget does not change the requirements governing Fund 675 expenditures.

Purchases and contracts will remain subject to the City's purchasing policies, available appropriations, applicable restrictions on the use of public benefit funds, and any separate Council approval requirements.

JUSTIFICATION:

Adoption of the annual budget establishes the City's legal authority to appropriate and expend funds for operations and services during the fiscal year.

FISCAL IMPACT:

Approval will establish Fiscal Year 2026-2027 estimated revenues and expenditure appropriations for Fund 675 in the amounts shown in the attached budget schedule. Fund 675 is supported by resources dedicated to Electric Utility public benefit activities. No General Fund impact is anticipated. Expenditures may not exceed Council-approved appropriations without subsequent authorization.
