AGENDA MATTER:
RESOLUTION PROVIDING NECESSARY FINDINGS FOR COMPLIANCE WITH COVID-19 PANDEMIC
RELATED RETIRED ANNUITANT EMPLOYMENT REQUIREMENTS AND APPROVAL OF
AMENDMENT TO EMPLOYMENT CONTRACT FOR INTERIM FINANCE DIRECTOR EXTENDING AGREEMENT’S TERM
EXECUTIVE SUMMARY:
On April 19, 2021, the City Council adopted a Resolution and approved an employment agreement to appoint Marc Puckett as Interim Finance Director. On October 4, 2021 the City entered into an amendment to the employment agreement with Marc Puckett, extending his term as Interim Finance Director until the earlier the following the dates: the end of the day when the Interim Finance Director has worked 960 hours since January 3, 2022 or two weeks after the new, permanent Finance Director begins work, thereby allowing for a transition period. Interim Finance Director Marc Puckett is approaching working 960 hours this fiscal year and is expected to reach such limit by the middle of January 2022.
The City is in the midst of its search for a permanent Finance Director. To ensure continued leadership of the City through the completion of the recruitment process, the City Council is asked to adopt the attached Resolution approving the attached Amendment No. 2 extending the Interim Finance Director contract to the earlier of the following dates: the end of the day when the Interim Finance Director has worked 960 hours since January 3, 2022 or two weeks after the new, permanent Finance Director begins work, thereby allowing for a transition period. Doing so will comply with Executive Order N-25-20 and CalPERS Circular Letter 200-056-21, which states that the 960-hour limit for fiscal year remains suspended during the declared state of emergency due to the COVID-19 pandemic.
DISCUSSION:
FISCAL IMPACT:
The City’s current budget contains sufficient payroll appropriations to cover the salary.
RECOMMENDED ACTION:
Adopt Resolution No. ____-2022 approving the employment agreement amendment and authorize the Mayor to sign it on behalf of the City.
