A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
BARSTOW AMENDING THE AT-WILL EMPLOYMENT
AGREEMENT BETWEEN THE CITY OF BARSTOW AND MARC
PUCKETT FOR INTERIM FINANCE DIRECTOR SERVICES
WHEREAS, on April 19, 2021, the City of Barstow and Marc Puckett entered into an At-Will Employment Agreement (“Agreement”) to provide Interim Finance Director Services; and
WHEREAS, the CITY and EMPLOYEE entered into an amendment to the Agreement on October 4, 2021 (Amendment No. 1) extending the Agreement until EMPLOYEE has worked 960 hours in a fiscal year or two weeks after the date on which the CITY’s new, full-time permanent Finance Director begins work, whichever is sooner; and
WHEREAS, the City Council now wishes to extend the Interim Finance Director’s term again; and
WHEREAS, the City and Marc Puckett have agreed to extend the term of the Agreement by amendment for a period of either 960 hours in a fiscal year or when the City has completing hiring of a new permanent Finance Director, whichever is sooner; and WHEREAS, Marc Puckett remains a retired annuitant with specialized skills as a former Finance Director who can assist the City for a short duration with navigating through the current declared federal, state, county, and city States of Emergency while the City is recruiting for a permanent Finance Director; and WHEREAS, the Interim Finance Director’s compensation will continue to not exceed the maximum monthly base salary paid to the former Finance Director; and the Interim Finance Director will not receive any benefits, incentives, compensation in lieu of benefits, or any other forms of compensation in addition to the hourly rate; and NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. The City Council hereby approves Amendment No. 2 to the At-Will Employment Agreement for Interim Finance Director services between the City of Barstow and Marc Puckett.
2. Amendment No. 2 to the At-Will Employment Agreement is hereby certified to comply with the requirements of Government Code sections 21221(h), and 21224, Executive Orders N-25-20, N-35-20, N-08-21, and CalPERS Circular Letters 200-015-20, 200-046-21, and 200-056-21. 272483.1
3. A copy of this Resolution shall be sent to the Director of the California Department of Human Resources.
