RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
BARSTOW AUTHORIZING CALIFORNIA CANNABIS EQUITY ACT
GRANT FUNDING
The City Council of the City of Barstow finds:
WHEREAS, the members of the California Legislature have recognized the need for cannabis equity grant funding; and
WHEREAS, funding has been provided to the Governor’s Office of Business and Economic Development to provide grant funds to local governments to help them establish cannabis equity programs; and
WHEREAS, cannabis equity programs are intended to assist populations and communities impacted by cannabis prohibition by providing them support and eliminating barriers to enter the newly regulated cannabis industry; and WHEREAS, in June 2021, the City Council passed Ordinance No. 974-2021 which permitted commercial cannabis businesses in the City; and WHEREAS, in October 2021, the City Council adopted Ordinance 977-2021, which promulgated comprehensive regulations for commercial cannabis businesses; and
WHEREAS, the City Council of the City of Barstow supports the development of a local cannabis equity program; and
WHEREAS, the City has applied for and been approved for a grant of $75,000 from the Governor’s Office of Business and Economic Development; and WHEREAS, the City Council of the City of Barstow has determined that it will use grant funds from the Governor’s Office of Business and Economic Development to conduct a cannabis equity assessment and/or assist the development of a local equity program.
NOW THEREFORE, the City Council of the City of Barstow hereby resolves as follows:
1. The City Manager of the City of Barstow is authorized to execute by electronic signature on behalf of City Council the grant agreement with the Governor’s Office of Business and Economic Development, including any extensions or amendments thereof and any subsequent grant agreement with the Governor’s Office of Business and Economic Development in relation thereto.
2. IT IS AGREED that any liability arising out of the performance of this grant agreement, including civil court actions for damages, shall be the responsibility of the grant recipient and the authorizing agency.
The Governor’s Office of Business and Economic Development and the State of California disclaim responsibility for any such liability.
