AGENDA ITEM
AGENDA MATTER:
INTRODUCTION OF ORDINANCE NO. ____-2022 AMENDING BARSTOW MUNICIPAL CODE SECTION 18.16.010 RELATING TO REVERSIONS TO ACREAGE, MERGERS AND
RESUBDIVISIONS, AND MERGER OF CONTIGUOUS PARCELS UNDER COMMON OWNERSHIP EXECUTIVE SUMMARY:
Staff recommends the City Council introduce Ordinance No. ____-2022, amending Barstow Municipal Code Section 18.16.010. The Planning Commission recommended approval at its December 13, 2021 meeting. The adoption of the proposed ordinance is exempt from review under the California Environmental Quality Act, per CEQA Guidelines Sections 15305 and 15378.
DISCUSSION:
DISCUSSION
The Subdivision Map Act (Gov. Code, § 66410 et seq.) allows local agencies to adopt by ordinance procedures for processing subdivision of land. If local agencies do not adopt an ordinance setting out rules for processing subdivision applications, then the default rules of the Subdivision Map Act apply. The City last approved a comprehensive update to its Reversions to Acreage and Lot Line Adjustment ordinance in 1986.
City Staff have determined that the City’s ordinance needs updating to streamline the City’s process for reversions to acreage, lot mergers, resubdivisions, and mergers of contiguous parcels under common ownership.
The City’s Municipal Code only sets out rules for reversions to acreage (Barstow Municipal Code Section
18.16.010) and lot line adjustments acreage (Barstow Municipal Code Section 18.16.020). The ordinance in front of the City Council would revise these rules as well as add rules governing the merger of contiguous parcels under common ownership and resubdivision. Doing so will help clarify and make it easier for landowners in the City to recombine, re-subdivide, and merge multiple parcels of their land as well as allow City staff to process such applications quicker. The ordinance allows for these kinds of land adjustments on a streamlined basis. Any later development projects on such land would still require full review and approval under all applicable provisions of the Barstow General Plan and Municipal Code.
ENVIRONMENTAL DETERMINATION
The ordinance does not require further review under the California Environmental Quality Act (“CEQA”) pursuant to subdivision (b) of CEQA Guidelines Section 15378, since the ordinance constitutes general policy and procedure making that, by streamlining and simplifying the process for merging and unsubdividing parcels, would not result in the creation of additional parcels that would have a potential for development resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment. The ordinance is also categorically exempt from CEQA pursuant to CEQA Guidelines Section 15305 for minor alterations to land use limitations that which do not result in any changes in land use or density.
