RESOLUTION NO. ______-2022
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BARSTOW,
CALIFORNIA AUTHORIZING THE CITY ENGINEER, WITH THE
APPROVAL OF THE CITY MANAGER, TO ENGAGE THE SERVICES OF
CONTRACTORS TO CONSTRUCT URGENT AND NECESSARY
REPAIRS TO THE FIRST STREET BRIDGE PURSUANT TO PUBLIC
CONTRACTS CODE SECTION 22050
The City Council of the City Of Barstow hereby finds, orders, and resolves as follows:
Section 1. On February 19, 2022, a single-vehicle collision caused structural damage to the First Street Bridge. Due to the damage the Bridge sustained and for the safety of the community, the First Street Bridge was closed until further notice to pedestrian and vehicle traffic.
Section 2. Based on the City Engineer’s opinion, there is an urgency to repair the First Street Bridge because of losing False Work that needs additional shoring and restraints, while bridge stringers are twisting and could fall out of position. In addition, the First Street Bridge is in need of additional blocking and columns to support the pedestrian walkway and address the emergency repairs to the existing loose columns and column wedges/caps.
Section 3. California Public Contracts Code Section 22050 permits the City Council to authorize the repair, or replacement of a public facility without giving notice of bids or letting contracts where the public interest and necessity demand the immediate expenditure of public money to safeguard life, health, or property; Section 4. This matter comes before the City Council on March 7, 2022, pursuant to a properly noticed agenda item to consider whether urgent conditions exist to warrant authorizing the City Engineer, with the approval of the City Manager, to engage the services of contractors to make the necessary repairs pursuant to Public Contracts Code Section 22050.
Section 5. The City Council has considered all of the evidence submitted into the administrative record, which includes, but is not limited to:
a. Agenda reports prepared by the City Engineer and the Community Services Department.
b. Staff presentation at the meeting held on March 7, 2022, before the City Council. c. The City of Barstow Municipal Code, and all other applicable regulations and codes.
d. Public comments, both written and oral, received and/or submitted at or prior to the meeting.
e. All related documents received and/or submitted at or prior to the meeting.
Section 6. In considering the staff report and the evidence presented at, and prior to the meeting on March 7, 2022, the City Council makes the following findings:
a. A part of the structure of the First Street Bridge is loose and twisting requiring immediate repair and additional supports for the safety of motorists that travel the bridge;
b. Inspection of the First Street Bridge by the City Engineer, Public Works personnel, and San Bernardino County Transportation Authority (SBCTA) representatives has found that immediate attention is needed to address the needed repairs. c. Construction of the necessary repairs requires jacking up cantilevered sections of the pedestrian walkway, and construction of additional columns and false work to support the failing areas.
d. The competitive bidding process is likely to take too much time to notice, prepare and review bids, and award a contract in order to complete the construction of the necessary repairs;
e. Based on substantial evidence set forth in the minutes, an urgent condition exists which will not permit a delay resulting from a competitive solicitation for bids; f. The existing emergency condition necessitates engaging one or more qualified contractors to make the necessary repairs as quickly as possible to address this urgent matter.
Section 7. The City Engineer, with the approval of the City Manager, is hereby authorized to engage one or more qualified contractors to make the necessary repairs to the First Street Bridge in an amount not to exceed $ 250,000.00.
Section 8. City staff shall report to the City Council at its next regular meeting on the status of the repair and the need for the authority contained herein.
Section 9. The City Council adopts this resolution by 4/5 vote as required by Public Contracts Code Section 22050.
Section 10. The time in which to seek judicial review of this decision shall be governed by Code of Civil Procedure Section 1094.6. The City Clerk shall certify to the adoption of this resolution and enter a certified copy of this resolution in the book of resolutions of the City.
PASSED, APPROVED and ADOPTED this 7th day of March, 2022.
