WHEREAS, If the City Council of the City of Barstow does not approve the continuing use of the “military equipment”—including by adoption of the Barstow Police Department’s proposed “military equipment” use policy—within one hundred and eighty (180) days of submission of the proposed “military equipment” use policy to the City Council of the City of Barstow, the Barstow Police Department shall cease its use of the “military equipment” until it receives the approval of the City Council of the City of Barstow. 278049.2 Page 2 of 3

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BARSTOW DOES ORDAIN AS FOLLOWS:

SECTION 1. FINDINGS.

The City Council of the City of Barstow finds and determines as follows:

A. The above recitals are true and correct.

B. The use of the “military equipment” governed by the procedure is necessary because there is no reasonable alternative that can achieve the same objective of officer and civilian safety.

C. The proposed “military equipment” use procedure safeguards the public’s welfare, safety, civil rights, and civil liberties by including standards governing specialized training needed for officers to use the equipment and appropriate uses and limits on uses of the equipment.

D. For all equipment proposed for purchase, the equipment is reasonably cost effective compared to available alternatives that can achieve the same objective of officer and civilian safety.

E. All prior “military equipment” use, before the effective date of this ordinance, complied with the “military equipment” use policies and procedures in effect at the time.

SECTION 2. APPROVAL OF THE BARSTOW POLICE DEPARTMENT’S
PROPOSED “MILITARY EQUIPMENT” USE PROCEDURE
The Barstow Police Department’s proposed “military equipment” use procedure—attached as Exhibit A and incorporated by reference—is approved.
