AGENDA MATTER:
APPROVAL OF CONTRACT ORDER 8 AND 9 FOR FIRST AVENUE OVER BNSF PROJECT EXECUTIVE SUMMARY:
Request for the City Council to authorize Contract Change Order #8 with Kleinfelder for the First Avenue Bridge over BNSF project.
DISCUSSION:
The contractual responsibility with Kleinfelder was to submit a final Plans, Specification, and Estimate (PS&E) package and one (1) comment / review cycle to address any questions, update the package and submit responses to the state. To proceed with the project, Kleinfelder responded to SBCTA on numerous comments not captured in older design packages, construct ability review, quantity independent checks, cost estimates, and SSPs iterations. Additionally, Kleinfelder supported the City and SBCTA on addressing comments from Highway Bridge Program (HBP) Head-Quarters (HQ) regarding construction funding, participating and non-participating items of work in the Cost Estimate, and justification of geometric designs. These activities required numerous additional meetings, revisions to the Cost Estimate and responses to formal review cycles. Change Order #8 for $50,000 and Change Order #9 for $156,000.00 is to cover the additional time and fees outside of the original scope of work for this phase that Kleinfelder and the sub-contractors have encountered.
FISCAL IMPACT:
An appropriation from available funds from Measure I is necessary to fund the Contract Change Orders.
Budget amendment in the amount of $206,000.00 is required and recommended for City Council approval.
RECOMMENDED ACTION:
Staff recommends that the City Council approve the following
1. Approve Contract Change Order #8
2. Approve Contract Change Order #9
3. Authorize the City Manager to approve and sign required documentations.
