COUNCIL ORDINANCE
AGENDA MATTER:

FIRST READING AND INTRODUCTION OF ORDINANCE AMENDING CHAPTER 13, SECTION

13.04.020 (DEFINITIONS) AND SECTION 13.20 (INSPECTIONS) OF THE BARSTOW MUNICIPAL CODE
EXECUTIVE SUMMARY:

A correction to ordinance number 965-2019 Industrial User Local Discharge Limitation Table is required to update Petroleum Hydrocarbons daily limit based on the study that was completed a few years ago. In addition, the city needs access to public utilities within easements, reservations, or right-of-way in or surrounded by private property.

DISCUSSION:

During an annual audit of ordinance number 965-2019, there was an error found in the Industrial User Local Discharge Limitation Table. Changing Total Petroleum Hydrocarbon limit from 0.50mg/l to 5.0mg/l.

This change has been tested and will have no impact on the City’s Wastewater Treatment Plant or its discharge permit.

During the same audit staff found no legal language in the Barstow Municipal Code (BMC) providing city employees legal access to public utilities within easements, reservations, or right-of-way in or surrounded by private property, if access is not granted, within reason, legal actions will be implemented. This section of the ordinance is instrumental in giving the City the ability to access, maintain, and repair the City’s utilities and deal with the issues associated with these types of activities.

FISCAL IMPACT:

None.

RECOMMENDED ACTION:

Staff recommends the City Council take the following action:

1. Approve the first reading and introduce, by title only, Ordinance No. ____-2022 , amending Chapter

2. Direct the City Clerk to bring the ordinance back to the City Council for the second reading and adoption at the next regularly scheduled meeting.
