A MESSAGE FROM THE CHIEF
It is my privilege to introduce the Barstow Police Department’s 2021 annual report. This report highlights some of the work accomplished by the 66 professional men and women of the Barstow Police Department. The Barstow Police Department is committed to providing professional, fair, and compassionate law enforcement services with integrity and respect.
As your Chief of Police, I want to assure you that our department is dedicated to serving the City of Barstow and we are committed to working with City leaders and our community to find better ways for us to serve.
The Barstow Police Department believes that community partnerships, comprehensive policing practices such as evidence-based policing strategies, and the use of technological innovations, are key components in deterring and reducing criminal activity in our community.
Our pledge to our citizens is to provide fair and ethical policing services and remain diligent in our efforts to make Barstow safe for all those who live, work and visit our great community.

ABOUT BPD
The Barstow Police Department employs 66 full-time employees, including 46 sworn police officers and 20 civilian staff. Our professional staff is proud to serve our community of over 25,000 residents. Every member of the Barstow Police Department is committed to our mission, goals, and core values: Integrity, Respect, and Commitment. To maximize resources and in order to provide the highest level of policing service to the Barstow community, the department has divided the City into three geographic areas called Patrol Beats: Western, Downtown, and College Heights. At any given time, there are 1-2 officers actively patrolling each Beat. This does not count Detectives, the Crime Impact Team, or other police personnel on duty.
In November of 2021, the department re-structured the Beats based on population and the number of anticipated service calls.

COUNCIL ORDINANCE
AGENDA MATTER:
SECOND READING AND ADOPTION OF ORDINANCE 990-2022 AMENDING SECTIONS 13.04.020 (DEFINITIONS) AND 13.12.340 (LOCAL DISCHARGE LIMITATIONS) AND CHAPTER 13.20 (INSPECTIONS) OF THE BARSTOW MUNICIPAL CODE
EXECUTIVE SUMMARY:
A correction to ordinance number 965-2019 Industrial User Local Discharge Limitation Table is required to update Petroleum Hydrocarbons daily limit based on the study that was completed a few years ago. In addition, the City needs access to public utilities within easements, reservations, or right-of-way in or surrounded by private property.
On May 16, 2022, the Council introduced Ordinance No. 990-2022 amending Chapter 13, Sections
13.04.020 (Definitions) and Section 13.20 (Inspections) of the Barstow Municipal Code. The ordinance is presented for its second reading and adoption.
DISCUSSION:
During an annual audit of ordinance number 965-2019, there was an error found in the Industrial User Local Discharge Limitation Table. Changing Total Petroleum Hydrocarbon limit from 0.50mg/l to 5.0mg/l.
This change has been tested and will have no impact on the City’s Wastewater Treatment Plant or its discharge permit.
During the same audit, staff found no legal language in the Barstow Municipal Code (BMC) providing City employees legal access to public utilities within easements, reservations, or right-of-way in or surrounded by private property, if access is not granted, within reason, legal actions will be implemented. This section of the ordinance is instrumental in giving the City the ability to access, maintain, and repair the City’s utilities and deal with the issues associated with these types of activities.
FISCAL IMPACT:
None.
RECOMMENDED ACTION:
Staff recommends the City Council take the following action:
Adopt Ordinance No. 990-2022, amending Sections 13.04.020 (Definitions) and 13.12.340 (Local Discharge Limitations) and Chapter 13.20 (Inspections) of the Barstow Municipal Code. The ordinance is exempt from review under the California Environmental Quality Act ("CEQA") pursuant to CEQA Guidelines sections 15060(c)(2}, 15060(c)(3}, 15061(b)(3} and 15378(b)(4). 5 Packet Pg. 68

DISCUSSION:
The City of Barstow began billing for sewer and trash (utility) services in November 2020 for customers who receive trash services within the incorporated city limits and/or for those who are connected to the City's sewer system. Barstow Municipal Code (BMC) Sections 6.20.210 and 13.22.060 authorize the periodic review of delinquent utility accounts. The code sections also authorizes collection of delinquent amounts through the lien process, as well constituting the delinquencies as a special assessment which can be assessed onto the property owner's tax bill.
Delinquent utility accounts are defined as those who have an unpaid (past due) balance after the delinquent (due) date. In order to properly notice those property owners who have a delinquent unpaid balance as of April 30, 2022, on their City of Barstow utility account, and pursuant to the BMC, staff is requesting the City Council establish the regularly scheduled meeting being held on Monday, July 18, 2022, at 7:00 p.m. in the City Council Chambers, located at 220 E. Mountain View St., Barstow, CA 92311, as the date, time, and place for hearing any objections or protests pertaining to delinquent trash and sewer accounts. City staff will send the required public hearing notice directly to delinquent property owners.
FISCAL IMPACT:
None.

EXECUTIVE SUMMARY:
On November 8, 2022, two (2) elected office vacancies will exist for the full term of four years. The adoption of the Resolution presented herewith will request that the Board of Supervisors of the County of San Bernardino consolidate Barstow’s General Municipal Election with the Statewide General Election to be held on November 8, 2022.
DISCUSSION:

(c) (1) In addition to the statement prepared pursuant to subdivision (a), if the elections official who is conducting the election permits electronic distribution of a candidate’s statement, the governing body of a local agency may permit each candidate for nonpartisan elective office in the local agency to prepare a candidate's statement for the purpose of electronic distribution pursuant to this subdivision. (2) A statement prepared pursuant to this subdivision shall be posted on the Internet Web site of the elections official, and may be included in a voter's pamphlet that is electronically distributed by the elections official pursuant to Section 13300.7, but shall not be included in a voter's pamphlet that is printed and mailed to voters pursuant to subdivision (b).
(3) A statement that is printed in the voter's pamphlet and mailed to voters pursuant to subdivision (b) shall be included with the statement that is prepared and electronically distributed pursuant to this subdivision. (4) A statement that is prepared and electronically distributed pursuant to this subdivision shall be displayed in type of uniform size and darkness, and with uniform spacing.
(5) The elections official shall provide a Spanish translation to those candidates who wish to have one, and shall select a person to provide that translation who is one of the persons listed in paragraph (2) of subdivision (b). (d) The local agency may estimate the total cost of printing, handling, translating, mailing, and electronically distributing candidate’s statements filed pursuant to this section, including costs incurred as a result of complying with the federal Voting Rights Act of 1965, as amended. The local agency may require each candidate filing a statement to pay in advance to the local agency his or her estimated pro rata share as a condition of having his or her statement included in the county voter information guide or electronically distributed. In the event the estimated payment is required, the receipt for the payment shall include a written notice that the estimate is just an approximation of the actual cost that varies from one election to another election and may be significantly more or less than the estimate, depending on the actual number of candidates filing statements. Accordingly, the local agency is not bound by the estimate and may, on a pro rata basis, bill the candidate for additional actual expense or refund any excess paid depending on the final actual cost. In the event of underpayment, the local agency may require the candidate to pay the balance of the cost incurred. In the event of overpayment, the local agency that, or the elections official who, collected the estimated cost shall prorate the excess amount among the candidates and refund the excess amount paid within 30 days of the election. (e) This section shall not be deemed to make any statement, or the authors of any statement, free or exempt from any civil or criminal action or penalty because of any false, slanderous, or libelous statements offered for printing electronic distribution pursuant to this section or contained in the county voter information guide. (f) Before the nominating period opens, the local agency for that election shall determine whether a charge shall be levied against that candidate for the candidate’s
