COUNCIL ORDINANCE
AGENDA MATTER:
SECOND READING AND ADOPTION OF ORDINANCE 990-2022 AMENDING SECTIONS 13.04.020 (DEFINITIONS) AND 13.12.340 (LOCAL DISCHARGE LIMITATIONS) AND CHAPTER 13.20 (INSPECTIONS) OF THE BARSTOW MUNICIPAL CODE
EXECUTIVE SUMMARY:
A correction to ordinance number 965-2019 Industrial User Local Discharge Limitation Table is required to update Petroleum Hydrocarbons daily limit based on the study that was completed a few years ago. In addition, the City needs access to public utilities within easements, reservations, or right-of-way in or surrounded by private property.
On May 16, 2022, the Council introduced Ordinance No. 990-2022 amending Chapter 13, Sections
13.04.020 (Definitions) and Section 13.20 (Inspections) of the Barstow Municipal Code. The ordinance is presented for its second reading and adoption.
DISCUSSION:
During an annual audit of ordinance number 965-2019, there was an error found in the Industrial User Local Discharge Limitation Table. Changing Total Petroleum Hydrocarbon limit from 0.50mg/l to 5.0mg/l.
This change has been tested and will have no impact on the City’s Wastewater Treatment Plant or its discharge permit.
During the same audit, staff found no legal language in the Barstow Municipal Code (BMC) providing City employees legal access to public utilities within easements, reservations, or right-of-way in or surrounded by private property, if access is not granted, within reason, legal actions will be implemented. This section of the ordinance is instrumental in giving the City the ability to access, maintain, and repair the City’s utilities and deal with the issues associated with these types of activities.
FISCAL IMPACT:
None.
RECOMMENDED ACTION:
Staff recommends the City Council take the following action:
Adopt Ordinance No. 990-2022, amending Sections 13.04.020 (Definitions) and 13.12.340 (Local Discharge Limitations) and Chapter 13.20 (Inspections) of the Barstow Municipal Code. The ordinance is exempt from review under the California Environmental Quality Act ("CEQA") pursuant to CEQA Guidelines sections 15060(c)(2}, 15060(c)(3}, 15061(b)(3} and 15378(b)(4).
