AMENDMENT TO CONTRACT AGREEMENT
Project 2010-14, Amendment 2
THIS AMENDMENT (“Amendment”) is made as of this 20th day of June, 2022, by and between the CITY OF BARSTOW (“City”) and Kleinfelder Inc. (“Consultant”).
RECITALS
WHEREAS, on October 20, 2015, the City and Consultant entered into an Agreement (“Agreement”) for the Consultant to provide Plans, Specifications, and Estimates (PS&E) phase of the North First Avenue Bridge over the BNSF Project; and
WHEREAS, the Parties have continued to perform under the terms of the Agreement after its October 20, 2020 purported expiration; and
WHEREAS, it is in the interest of both Parties to extend the agreement an additional five years and two months on the same terms as the original Agreement.
NOW THEREFORE, THE CITY AND THE CONSULTANT AGREE AS FOLLOWS:
1. Paragraph “Article IV Performance Period” is amended to read:
A. This contract shall go into effect on June 20, 2022, contingent upon approval by LOCAL AGENCY, and CONSULTANT shall commence work after notification to proceed by LOCAL AGENCY’S Contract Administrator. The contract shall end on (December 20, 2025), unless extend by contract amendment.
2. PROVISIONS OF AGREEMENT. All other terms, conditions, and provisions of the Agreement to the extent not modified by this Amendment, shall remain in full force and effect. “City”
