RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BARSTOW,
CALIFORNIA MAKING DETERMINATIONS AND CONFIRMING
ASSESSMENTS AND PROCEEDINGS FOR UNPAID TRASH COLLECTION
AND/OR SEWER FEES
WHEREAS, the Finance Director of the City of Barstow has filed in the office of the City Clerk of said City, an assessment for certain unpaid trash collection and/or sewer fees in said City, in accordance with Section 620.210 and
13.22.060 of the Barstow Municipal Code.
WHEREAS, the Finance Director has, as required, given notice of time fixed for hearing by the City Council; and
WHEREAS, all property owners involved in this assessment have been duly notified of the time and place of said hearing fifteen (15) days prior to said hearing; and
WHEREAS, a hearing was held before the City Council of the City of Barstow at 7:00 p.m. on July 18, 2022, in the City Council Chambers, 220 East Mountain View Street, Barstow, California, the time and place fixed in such notice; and WHEREAS, present at the hearing on Monday, July 18, 2022, were three (3) members of the City Council. Due to abstention requirements, certain parcels were required to be abstained from voting by at least one (1) of the three (3) City Council members who were present; therefore, certain parcels could not be voted on at the July 18, 2022, hearing and the protest hearing was continued to Monday, August 1, 2022; and
WHEREAS, during the hearing held on July 18, 2022 and August 1, 2022, all appeals, protests or objections, if any, were duly presented and the City Council gave all persons noticed and present desiring to be heard, an opportunity to be heard in respect to any matter relating to said assessments, to the corrections of said assessments, or to any matter relating to said assessments or the proceedings therefore; and
WHEREAS, all such persons desiring to be heard have been heard by the City Council and the City Council is fully informed of the premises.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BARSTOW DOES HEREBY FIND, DETERMINE AND ORDER AS FOLLOWS:
1) That said hearing has been duly held; that each and every step in the proceedings prior to and including the hearing has been duly and regularly taken; that this City Council is satisfied with the correctness of the assessment; the proceedings and all matters relating thereto; and that all Resolution No. _____-2022

protests, objections, or appeals are hereby overruled and denied; and the City Council does hereby confirm said proceedings and said assessments.
2) That the fees for the sewer and trash collection shall be assessed against the benefiting property and shall be assessed as a lien on the property benefited thereby, which lien shall be included on the tax roll for taxes levied against the property.
3) That the prorated first year interest @1.5% per month, a penalty of 10% of lien unpaid balance and the administrative cost of preparing the liens and assessments will be added to the delinquent amounts and assessed against the benefiting properties.
4) That additional interest shall be charged by the County of San Bernardino if the balance remains unpaid for more than one year.
5) That the parcels to be liened and the amount of said lien are set forth on Exhibit “A” attached hereto and made a part thereof.
