RESOLUTION NO. ____ - 2022
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BARSTOW, CALIFORNIA
AMENDING THE CITY'S CONFLICT OF INTEREST CODE WHICH INCORPORATES
BY REFERENCE THE STANDARD CONFLICT OF INTEREST CODE PREPARED BY
THE FAIR POLITICAL PRACTICES COMMISSION AND REPEALING RESOLUTION NO. 5004-2020
THE CITY COUNCIL OF THE CITY OF BARSTOW DOES HEREBY FIND, RESOLVE AND ORDER AS FOLLOWS:
Section 1. The Political Reform Act, Government Code Sections 81000, et seq., requires the City to adopt a Conflict of Interest Code for each department of the City.
Section 2. The Fair Political Practices Commission has adopted a standard Conflict of Interest Code, attached hereto as Exhibit A. The standard code, which is codified at 2 Cal. Administrative Code Section 18730, can be incorporated by reference by the City, and will be amended to conform to amendments to the Political Reform Act.
Section 3. The standard Conflict of Interest Code adopted by the Fair Political Practices Commission attached hereto as Exhibit A, and as amended from time to time, and Appendices A and B, which set forth the designated positions and the disclosure categories for each City officer or employee, are herein incorporated by reference and constitute the Conflict of Interest Code for each department of the City.
Section 4. Persons holding designated positions listed in the appendices shall file statements of economic interest pursuant to Section 4 of the Conflict of Interest Code.
Section 5. The City Clerk of the City of Barstow is hereby designated as the filing officer to receive the filed statements, except as provided for in Section 6.
Section 6. The Fair Political Practices Commission is hereby designated as the filing officer to receive statements filed by the City Councilmembers, City Manager, City Attorney, Chief Financial Officer/City Treasurer, and Planning Commission members.
Section 7. Resolution No. 5004-2020 is hereby repealed.
Section 8. The City Clerk shall certify as to the adoption of this resolution and shall cause the same to be processed in the manner required by law.
