RESOLUTION NO. 4331 -2007
HOC COMMITTEE
THE CITY COUNCIL OF THE CITY OF BARSTOW HEREBY FINDS, DETERMINES, ORDERS AND RESOLVES AS FOLLOWS:
Section 1. The City Council of the City of Barstow, in order to facilitate the conduct of City business, wishes to establish several ad hoc committees; and to delegate to each certain responsibility to review issues within its assigned subiect area and to make recommendations to the full City Council concerning the resolution of such issues.
Section 2. The City Council of the City of Barstow hereby establishes an ad hoc, advisory committee consisting of five members, two of whom are to be City Council members; to be known as the Rules and Policies Ad Hoc Committee to advise the City Council with regard to certain matters. Specifically, the Council is asking that:
1. The Committee review the proposed Personnel Policies and Procedures of the City of Barstow for compliance with applicable federal and state law and with applicable provisions of the Barstow Municipal Code; and for appropriate policy issues;
2. The Committee review the City's Classification Plan for compliance with the Barstow Municipal Code and the proposed Personnel Policies and Procedures of the City of Barstow and for competitiveness within the public service market; and
3. The Committee review policy issues related to the personnel and administrative functions of the City as referred by the City Council or the city manager.
Section 3. Sunset Date. The Rules and Policies Ad Hoc Committee will sunset on December 31, 2008 unless the City Council takes action before then to renew its mandate. Technical support is provided to the Rules and Policies Ad Hoc Committee by staff members assigned by the city manager.
Section 3. Rules and Policies Ad Hoc Committee Meetings.
The Rules and Policies Ad Hoc Committee may, at its discretion, establish a regular schedule of meetings, including the time and place of such meeting. However, the Rules and Policies Ad Hoc Committee shall be required to meet at least once in each quarter of the fiscal year.
Section 4. Records of the Proceedings of the Rules and Policies Ad Hoc Committee. The Rules and Policies Ad Hoc Committee may, at its discretion, maintain a record of Committee proceedings via tape recordings. Should the Committee elect to do this, such tape recordings shall be maintained by the City for a minimum of 30 days following the date of the Committee's meeting.
Section 5, Nature of Committee. The Rules and Policies Ad Hoc Committee is ad hoc and advisory in nature. That is, the Committee shall not have authority to act on behalf of the full City Council on those matters requiring City Council action. Rather, the Committee may present its recommendations on those issues requiring City Council action to the full City Council for consideration, debate and action at a regular or special meeting of the City Council.

AGENDA MATTER:
ESTABLISHMENT OF NEW COMMITTEES (ON POLICE AND COMMUNITY
RELATIONS, STREET, AND RULES AND POLICIES) AND APPOINTMENT OF
THEIR MEMBERS
EXECUTIVE SUMMARY:
The Council is being asked to formalize its previous consensus to create a Police and Community Relations Committee, a Street Committee and a Rules and Policy Committee.
DISCUSSION:
The Council may wish to consider whether or not it wishes to create committees subject to the procedural requirements of the Brown Act. Making the committees ad-hoc committees composed solely of less than a quorum of the Council would avoid the paper-work requirements of the Brown Act (e.g., preparing and posting written agendas in advance), and thus reduce the requirements for ongoing staff support. Committee meetings can be held in public and receive public input regardless of whether or not the committees are subject to the Brown Act.
The proposed resolutions (attached) would create ad-hoc committees not subject to the formal requirements of the Brown Act that would sunset in two years. At that time, the Council could decide whether it wished to continue them.
