COUNCIL AGENDA ITEM
AGENDA MATTER:

APPROVAL OF CODE COMPLIANCE OFFICER I POSITIONS, SR. COMMUNITY DEVELOPMENT INSPECTOR, ADMINISTRATIVE ASSISTANT AND OFFICE ASSISTANT.

EXECUTIVE SUMMARY:

DISCUSSION:

In June 2021, the City Council passed Ordinance No. 974-2021 that added Chapter 19.27 to the Barstow Municipal Code to permit commercial cannabis activities in the City. The ordinance went into effect on July 7, 2021. On October 4, 2021, the City Council adopted Ordinance No. 977-2021, amending the City’s cannabis regulatory program ordinance. All cannabis businesses must enter into a development agreement with the City that will be subject to council approval through the adoption of an ordinance under Government Code Section 65865.

At previous council meeting’s, five (5) cannabis permits were approved. In total, there have been thirtyone (31) various types of applications submitted at $18,644.85 totaling $577,990.35 collected. Once in operation, each cannabis operation is required to pay $550 each quarter for an inspection totaling $2,200 a year in inspection fees per permit. In addition, each cannabis operation is required to pay $14,107.85 for the license renewal. Once in operation, there will be 31 permits issued and the total permitting fees and inspection fees will be $16,307.85 each license. For thirty-one (31) annual permits, the total collected will equal $505,543.35 per year.

The annual permit fees and quarterly inspection fees should cover the cost of the inspection, administrative duties, paper, and postage for mail, Finance support and I.T. support. Support from other departments is estimated at approximately $100,000 per year. Additional staff will be required to conduct the annual inspections. Staff believes adding two (2) Code Compliance Officers to the current Code Compliance Department will be sufficient to complete the quarterly inspections and regular monitoring of the facilities. The Senior Community Development Inspector Position will oversee the Cannabis inspections. The addition of a Senior Community Development Inspector will provide the needed knowledge to perform and provide oversite of complex inspections that will take place at the facilities for the extraction/volatile process of the manufacturing of cannabis. In addition, an Administrative Assistant will coordinate and schedule inspection for the Cannabis Division. The Office Assistant will help manage the phones and the increase in desk traffic that is associated with the Cannabis Division. The Administrative Assistant and Office Assistant will be assigned to the Community Development Department.

FISCAL IMPACT:

The fiscal impact will be covered by fees associated with the Cannabis Permit and Inspection fee. Staff is proposing the addition of two (2) Code Compliance Officer I positions, one (1) Administrative Assistant position, one (1) Office Assistant and one (1) Sr. Community Development Inspector. The total cost for (2) Code Compliance I positions will be approximately $137,034.80 at their A step and $167,558.48 at their F step with all benefits included. In addition, an Administrative Assistant position will cost approximately $73,521.47 at the A step and $90,380.01 at the F step with all benefits included. An Office Assistant will cost approximately $65,044.67 at the A step and $79,565.73 at the F step with all benefits included. The Joint Special Council/BFPD
