COUNCIL RESOLUTION
AGENDA MATTER:

RESOLUTION NO. ____-2023 TO INITIATE PROCEEDINGS TO REAFFIRM THE LEVY AND

COLLECTION OF ANNUAL ASSESSMENTS AND ORDERING THE CITY ENGINEER TO PREPARE AN ENGINEER’S REPORT FOR LANDSCAPING ASSESSMENT DISTRICT #1, STREET MAINTENANCE ASSESSMENT DISTRICT #1, STREET LIGHTING ASSESSMENT DISTRICT #1, AND FLOOD CONTROL ASSESSMENT DISTRICT #1
EXECUTIVE SUMMARY:

In accordance with Section 22566 of the Streets and Highways Code, the City must annually reaffirm the active assessment districts located within Barstow. To comply with this requirement, staff recommends that the City Council approve Resolution No. ____-2023 directing the City to present the updated Assessment District Engineer's Report for consideration at a public hearing to be held on July 17, 2023.

DISCUSSION:

In 1988, the City of Barstow approved the formation of the Street Lighting and Flood Control Maintenance District #1 for all new subdivisions, and in 1990, approved the formation of the Landscaping and Street Maintenance District #1.

Annual maintenance and operation costs associated with street maintenance, drainage, street lighting, and landscaping are assessed on a pro-rata basis to each of the properties within the Maintenance District and are included on the annual property tax statement. The Engineer’s Report indicates all existing assessments to be levied within Maintenance District #1. As a result of Proposition 218, assessments may not be increased without a vote of the property owners.

In order to remain active and in accordance with Section 22566 of the Streets and Highways Code, a report shall be prepared for each fiscal year for which assessments are to be levied and collected and the City Council is required to annually reaffirm the assessment districts.

As part of the reaffirmation process, the City Engineer is also required to present an updated Assessment District Engineer’s Report. By approving the attached resolution, the City Council would be directing staff to prepare the report and conduct a public hearing on July 17, 2023, to consider the contents of that report.

FISCAL IMPACT:

None
RECOMMENDED ACTION:

Approve Resolution No. ____-2023 to initiate proceedings to reaffirm the levy and collection of annual assessments and order the City Engineer to prepare an Engineer’s Report for Landscaping Assessment District #1, Street Maintenance Assessment District #1, Street Lighting Assessment District #1, and Flood Control Assessment District #1, and waive the full reading.
