CITY COUNCIL RESOLUTION NO. XXXX-2023
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
BARSTOW, CALIFORNIA APPROVING REVISIONS TO THE
CITY’S PURCHASING AND CONTRACT POLICY
WHEREAS, Barstow Municipal Code Chapter 2.40 defines the City of Barstow’s purchasing system; and
WHEREAS, the City Council last reviewed and updated guidelines, policies, rules, and regulations for purchasing transactions in May 2021 complied as part of the City’s Purchasing and Contract Policy; and
WHEREAS, the City Council desires to update the City’s Purchasing and Contract Policy for its purchasing system to enhance efficiencies, reduce cost and maintain proper internal controls over purchasing transactions.
NOW, THEREFORE, the City Council of the City of Barstow does hereby resolve as follows:
SECTION 1. Recitals
The City Council finds that all the facts, findings, and conclusions set forth above in this Resolution are true and correct.
SECTION 2. Approval of the City’s Purchasing and Contract Policy The City Council adopts the revised Purchasing and Contract Policy, attached as Exhibit A to this Resolution, on behalf of the City of Barstow, the Barstow Fire Protection District, and all other City entities.
All previous versions of the Purchasing and Contract Policy are hereby repealed.
Any and all resolutions in conflict with this Resolution are also hereby repealed.
SECTION 3. City Manager Authority
The City Manager has the authority to promulgate administrative procedures and regulations to implement the provisions of this article. These administrative procedures and regulations shall not change the bidding thresholds established by the ordinance.
SECTION 4. Severability Clause:
Should any section, clause, or provision of this Resolution be declared by the Courts to be invalid, the same shall not affect the validity of the Resolution as a whole, or parts thereof, other than the part so declared to be invalid. 305051.v1
SECTION 5. Certification:
This Resolution shall take effect immediately and the City Clerk shall certify to the passage and adoption of this Resolution and shall cause the same to be published or posted according to law.
SECTION 6. CEQA. The City Council finds the adoption of this resolution is exempt from review under the California Environmental Quality Act because it relates to an administrative matter. (CEQA Guidelines, 14 Cal. Code of Regulations, Section 5061(b)(3) and 15378(b)(5).
