A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BARSTOW, CALIFORNIA, AMENDING
THE FEE SCHEDULE AND ADOPTING FEES FOR POLICE, CANNABIS REGULATIONS, AND COMMUNITY DEVELOPMENT FEES (FY 2023/2024)
EXECUTIVE SUMMARY:
Staff completed the annual process of thoroughly reviewing the City's fees in effect for the 2023/2024 Fiscal Year. Subsequent to this review, staff presented the Master Fee Schedule to the City Council for consideration at the June 5, 2023, Council meeting. Since that meeting, staff were made aware that fees related to the Police Department, Cannabis Regulations, and Community Development, were not included in the fee schedule. The Resolution to adopt the Fiscal Year 2023/2024 proposed changes to the Police Department, Cannabis Regulations, and Community Development Fee Schedules is attached (Attachment 1) for the Council's review and consideration.
DISCUSSION:
Staff completed the annual process of thoroughly reviewing the City's fees in effect for the 2023/2024 Fiscal Year. Subsequent to this review, staff presented the Master Fee Schedule to the City Council for consideration at the June 5, 2023, Council meeting. Since that meeting, staff were made aware that fees related to the Police Department, Cannabis Regulations, and Community Development, were not included in the fee schedule. The proposed fee schedule has been amended to include the following:
- Vehicle Release Fee of $125.00 pursuant to California Vehicle Code Section 22850.5; - City Attorney Fees based on provider’s rates and actual cost for review of cannabis-related applications, development agreements, etc.
- City Council Notice of Public Hearing Fee based on provider’s rates and actual cost for notification in a newspaper of local circulation;
- Modification(s) to Existing Conditional Use Permit Fee of $1,109.00.
If approved, the newly adopted fee schedule will go into effect immediately after the Council’s approval unless otherwise noted. These proposed changes are included in the attached table recommended for adoption.
FISCAL IMPACT:
The proposed Vehicle Release Fee is charged by the City of Barstow pursuant to California Vehicle Code Section 22850.5. The proposed Cannabis Regulation Fees are charged based on the actual cost of attorney’s fees and newspaper publication fees paid by the City. The proposed Community Development permit fee is based on the existing Conditional Use Permit application fee, both initial applications and modifications prompt the same staff processes and newspaper publication fees.

Staff recommends that the City Council adopt the attached Resolution No. ____-2023 amending the Fiscal Year 2023/2024 Fee Schedule and adopting fees for Police, Cannabis Regulations, and Community Development Permit Fees, and waive the full reading. This approval is exempt from review under the California Environmental Quality Act, per CEQA Guidelines, Title 14, CCR, section 15378(b)(4- 5).
