AGENDA ITEM
AGENDA MATTER:

APPROVAL AUTHORIZING THE CITY MANAGER TO SIGN A CONTRACT OVER THE ONE MILLION DOLLAR LIMIT SET BY RESOLUTION 5130-2023. THIS APPROVAL IS FOR A ONE TIME

CONTRACT WITH FORT IRWIN AND THE SUB-CONTRACTOR NOT TO EXCEED ONE MILLION TWO HUNDRED AND FIFTY THOUSAND DOLLARS.

EXECUTIVE SUMMARY:

That the City Council is asked to authorize the City Manager to sign a contract in excess of one million dollars and not to exceed one million two hundred and fifty thousand dollars. Per Barstow Municipal Code section 2.40.100 and City Council Resolution 5130-2023, any contracts or agreements under the Intergovernmental Service Agreement, Annex S for public works projects and related general facility construction services for Fort Irwin in excess of one million dollars will be brought before the City Council to authorize the City Manager to sign the contracts. Resolution 5130-2023 is attached for reference.

DISCUSSION:

Intergovernmental Service Agreements (“IGSAs”) are agreements between the United States and local governments in which the local government provides services or contracts with a third party to provide the services requested by the United States. The City entered into IGSAs with the United States Army for mail room and animal control services at Fort Irwin in 2021 and for waste hauling services and base operations support services in 2022.

The United States Army approached the City to inquire whether it was willing to sign an annex to the IGSA where the Army could ask the City to perform public works projects at Fort Irwin, such as infrastructure repair projects and new and modified facility construction contracts.

The United States Army contacted the City and inquired if we would be interested in performing a modification to the existing landfill at Fort Irwin which is not in full compliance with applicable federal and state regulations. After discussing the options with Fort Irwin and the LEA (Local Enforcement Agency), the City accepted, subject to the necessary approvals. The contract, as bid by the US Army, is more than the one million dollar signing authority of the City Manager, thus prompting staff to bring forward this agenda item asking for the City Manager to be authorized to sign the agreements between Fort Irwin, the City, and the sub-contractor performing the work.

FISCAL IMPACT:

City staff is expecting the revenue generated by the 3% fee to be in excess of $36,000.

RECOMMENDED ACTION:

Staff recommends that the City Council:
1) Authorize the City Manager to sign and implement contracts worth more than one million dollars and not to exceed one million two hundred and fifty thousand dollars for landfill improvements at Fort Irwin, under the City’s existing Fort Irwin Intergovernmental Service Agreement. This approval is exempt Joint Special Council/BFPD
