Fiscal Impact
City staff is examining the fiscal impact of entering into this annex agreement, but estimates that its financial effect will be positive. Entering into the IGSA annex may require the City to hire additional staff to manage it. The IGSA Annex is designed to dovetail with the individual project agreements, such that the contractors for the work as performed for each project will, if approved, invoice the City for their services, and in turn the City will invoice the Army for those costs, plus a three percent management fee, and the City would then pay the contractors upon receipt of funds from the Army.
Executive Summary
The City Council is asked to enter into an annex to an Intergovernmental Service Agreement that it entered into in on May 25,2022, with the United States Army for base operations support services at Fort Irwin.
Discussion
Intergovernmental Service Agreements ("IGSAs") are agreements between the United States and local governments in which the local government provides services or contracts with a third-party to provide the services requested by the United States. The City entered into IGSAs with the United States Army for mail room and animal control services at Fort Irwin in 2021 and for waste hauling services and base operations support services in 2022.
As part of the original IGSA, the City of Barstow entered into a separate contract with High Desert Support Services ("HDSS") and SpecPro to provide the various services requested by the United States Army, under the City's management.
The United States Army approached the City to inquire whether it was willing to sign an annex to the IGSA where the Army could ask the City to perform public works projects at Fort Irwin, such as infrastructure repair projects and new and modified facility construction contracts. Staff has prepared the attached IGSA Annex S and related Resolution of Approval for Council consideration.
Recommended Action
Staff recommends that the City Council:
1) Approve the annex to the IGSA with the United States Army. 2) Adopt Resolution No. 5130-2023 Authorizing the Approval of Annex S for General Facility Construction Services to the Intergovernmental Services Agreement with the United States Army Garrison, Fort Irwin and Authorizing the City Manager or designee the authority to sign the annex to intergovernmental support agreement between Fort Irwin and the City of Barstow, with any necessary non-substantive changes, and to perform all other necessary acts to implement the agreements, including approving individual projects under Annex S up to $1 million per project.
The adoption of this Resolution and approval of this agreement are exempt from review under the California Environmental Quality Act, per CEQA Guidelines, Title 24, CCR, section 15301.
