AGENDA ITEM
AGENDA MATTER:

PRESENTATION OF PROCLAMATION TO DONATE LIFE CALIFORNIA IN RECOGNITION OF

DMV/DONATE LIFE MONTH
EXECUTIVE SUMMARY:

A proclamation will be presented to Donate Life California in recognition of DMV/Donate Life Month.

DISCUSSION:

In April, the U.S. Department of Health and Human Services has designated it as National Donate Life Month to increase public awareness about the urgent need for organ, tissue, marrow, and blood donations. In California alone, over 20,000 individuals are awaiting life-saving organs, with more than 100,000 across the nation. Due to the limited number of donors, 17 people lose their lives daily while waiting for a transplant. A single donor can potentially save eight lives by donating vital organs like the heart, kidneys, lungs, pancreas, liver, and small intestine. Additionally, they can positively impact 75 others by donating corneas and tissues such as bone, skin, veins, and tendons.

It is only fitting that the City of Barstow show its support of the Donate Life California Donor Registry program and recognize the importance of donating organs and tissues to save lives. A proclamation will be presented to Donate Life California. Donate Life Ambassador Terri Pilawa will be present to accept the proclamation on behalf of Donate Life California. Ms. Pilawa is eight years and seven months postdouble lung transplant and is very grateful for a second chance at life.

AGENDA ITEM
AGENDA MATTER:

GRIT CHAMBER REHABILITATION PROJECT
EXECUTIVE SUMMARY:

Staff seeks the City Council's approval to enter into an agreement with National Coating in an amount of $77,320.

This sulfuric acid attacks concrete compromising the integrity of the structure.

FISCAL IMPACT:

Use $77,320 form 605 Wastewater Reclamation account 605.605.601.08.837 (Equipment Budget) for FY24
RECOMMENDED ACTION:

Staff recommends that the City Council take the following actions:

1. Approve the Grit Chamber Rehabilitation with National Coating for repairing deteriorated concrete and applying the protective coating of Sherwin Williams poly coat 115.

AGENDA ITEM
AGENDA MATTER:

APPOINTMENT OF PLANNING COMMISSIONER
EXECUTIVE SUMMARY:

A Planning Commission seat previously held by Miguel Morales was vacated on December 31, 2023.

During the meeting on December 18, 2024, the City Council formed a committee and proposed that Council Members Rose and Hernandez assist in conducting interviews and provide recommendations to fill the vacant position.

DISCUSSION:

In accordance with Section 2.24.035 of the Barstow Municipal Code, the Planning Commission members must be appointed after notifying the City Council of any vacancies or expiring terms. The City Council, upon being informed of an upcoming vacancy on December 18, 2023, opted to publicly announce the opening and formed a Selection Committee consisting of Council Members Rose and Hernandez to recommend a candidate for the position.

After receiving four applications, interviews were conducted by the Committee on April 9, 2024. After a lengthy discussion, the Committee's recommendation, for the Council's consideration, is Paul Neimeyer.

With 25 years of residency in Barstow, Mr. Neimeyer serves as a Program Manager for USMC.

Following tonight's decision, the newly appointed Commissioner will take the oath at the upcoming Planning Commission meeting.

FISCAL IMPACT:

None.

RECOMMENDED ACTION:

The Selection Committee recommends the City Council appoint Paul Neimeyer as a Planning Commissioner for one term, (to end 12/31/2027).

COUNCIL AGENDA ITEM
AGENDA MATTER:

AN AMENDMENT TO THE AGREEMENT FOR THE JOINT EXERCISE OF POWERS RELATED TO

THE SAN BERNARDINO ASSOCIATED
EXECUTIVE SUMMARY:

The City of Barstow is a Member Agency of the San Bernardino Council of Governments (SBCOG), which is governed by the San Bernardino Associated Governments Joint Powers Authority (JPA) composed of 24 cities and towns and the five San Bernardino County Supervisorial Districts. The SBCOG provides a forum for member agencies to exchange information and collaborate on regional issues, thus improving coordination, leveraging resources, reducing duplication of effort, and strengthening regional advocacy.

The JPA agreement specifies the methodology by which Member Agencies are assessed membership dues. These are currently calculated on an original assessment based on each Member Agency’s population (50%) and assessed property valuation (50%), and two flat fees of $5,337 and $8,000, adopted in 2016 and 2022, respectively, per Member Agency. The City of Barstow currently pays $14,537 in annual membership dues.

DISCUSSION:

In 2018, the SBCOG Board adopted a five-year work plan with funding for its implementation provided by two primary sources, membership dues and Property Assessed Clean Energy (PACE)/Home Energy Renovation Opportunity (HERO) funds. The work plan includes the Emergency Communications Nurse System, the Inland Regional Energy Network, the Smart County Master Plan, and Grant Assistance, including the Active Transportation Program (ATP) and Regional Early Action Plan (REAP) Grants.

ISSUES/ANALYSIS
On July 5, 2023, the SBCOG Board received a report on the 2018 work plan and funding showing that HERO funds, the SBCOG’s main supplemental fund source, had been depleted. Budget projections showed there would be insufficient funding to continue to implement existing programs, with the agency operating at a deficit in FY 2026-27 under the status quo. An Ad Hoc Committee was created and tasked with discussing the expansion of the COG’s capacity and increasing the dues paid by the member agencies. The committee researched the funding sources, budgets, programs, and operations of other councils of governments (COGs) in the area and identified three options for calculating dues moving forward, ultimately recommending an increase in the SBCOG’s work capacity, including adding staff and increasing its budget, and a change in the calculation of dues. The new assessment would be based on population (50%) and general fund tax revenues (50%), added to the current assessment. In addition to the assessment for baseline services, optional subscription services would be available at an additional cost. Annual cost increases would be imposed according to the Consumer Price Index (CPI) or 2%, whichever is less.

In January 2024, the SBCOG Board accepted the Ad Hoc Committee’s recommendation and approved Amendment No. 4 to the JPA agreement. Amendment No. 4 officially changes the name of the organization from San Bernardino Associated Governments (SANBAG) to San Bernardino Council of Governments (SBCOG) and removes the specific formula for assessing member dues, which is instead to be determined by Board-approved policy, thus providing the Board flexibility in the future if the method for assessing member agency dues needs to change. The formula to calculate membership dues would be 10 Packet Pg. 32

modified as previously noted, which would increase the estimated membership dues for the City of Barstow incrementally over 2 years from the current amount of $14,537 to $19,724 in FY 2024-25 and then to $24,784 in FY 2025-26, requiring a total increase of $10,247.

The new member dues would go into effect July 1, 2024.

FISCAL IMPACT:

The proposed JPA amendment will modify the current formula to calculate membership dues. The estimated membership dues for the City of Barstow would increase incrementally over 2 years from the current amount of $14,537 to $19,724 in FY 2024-25 and then to $24,784 in FY 2025-26, requiring a total increase of $10,247.

RECOMMENDED ACTION:

Approve Amendment No. 4 to the San Bernardino Associated Governments Joint Powers Authority agreement and approve the increase to the City of Barstow member dues to $24,784, with an annual price increase based on the Consumer Price Index (CPI) or 2%, whichever is less. 10 Packet Pg. 33

Sole Source
Xybix is the sole manufacturer and distributor of our consoles. Xybix does not offer products to any resellers or distributors. Our team of employees work directly with companies like yours to provide the best service and price. This is done throughout the life of the project from design to install to warranty and customer service.

While other manufacturers of dispatch consoles may have a few of the following features none have the complete package like Xybix. Our RollerVision really stands out with a utility patent. This patent will be protected by Xybix.

General Sole Source
Ergonomics – All the Xybix stations are designed to meet the ANSI-HFES 100-2007 ergonomic standard. This standard sets 5 requirements for any furniture manufacturer to meet this standard:

Keyboard height adjustment, monitor height adjustment, Focal Depth Adjustment, Reach Zone, and Knee space. Xybix is the only console manufacturer which meets all 5 of these requirements.

BIFMA – Business and Institutional Furniture Manufacturers Association. Xybix has tested all our appropriate products with BIFMA. This includes the X5.6-2003 test for panel systems, X5.9-2004 for Storage Cabinets, and X5.5-2008 for height adjustable tables. Xybix is the only company to be tested on all three and pass. Test results can be provided.
3-D Laminate – Xybix is the only dispatch manufacturer to provide seamless worksurfaces which provide a superior surface compared to standard laminate with separate material for edging. The elimination of the traditional seam between the flat laminate and the edge is a place for bacteria and gunk especially in the 24/7 market.

The 24/7 market requires regular wipe downs using a bleach concentrate to clean the surface between each shift. The seamless surface provides easier wipe down and increases the chance for a cleaner, healthier workplace where the stations are manned 24/7.

Monitor Adjustments – Xybix has a patent on our RollerVision which is a multiple monitor focal depth adjustment platform. This allows the user to adjust all the monitors to their best focal depth all at the same time. Even when there are two rows in height of monitors.

Other furniture systems use monitor arms which require an individual pull for each monitor which decreases ergonomics and discourages use due to time consumption to individually adjust.

www.xybix.com
The RollerVision can also adjust to larger monitors later. For example, as larger monitors become more compatible with software, the RollerVision can accommodate up to a 50” monitor along with curved monitors.

Computer Storage – Electronic equipment must be positioned in such a way as to permit easy access for re-booting or the servicing of CPU’s without removing panels or crawling under the console in the dark. Xybix Systems, Inc. designs all electronics cabinets with either a side entry door, flip-top surface with angled shelf or slide out shelves for easy access and redundant built-in fan ventilation to keep equipment cool. This makes service easier for both techs and outside contractors to access necessary equipment. The flip-top and Tech Tower style cabinets are unique to Xybix.

Cable Management - Cables are easier to access when in our cable bridges. Cable bridges attach a lift case to a CPU cabinet allowing separate cable chase paths for power and data with the enhanced feature of strength and stability for the entire console. These are not at the back of the station like the competitors but near the front for easier access.

AXYS – OPTIONAL Integrated control system shall be downloadable as an application onto a Windows, iOS, or Android device. Integrated software system shall control airflow, heating, task light dimming and a status indicator light. Optional light controls with presets for up to four lights to include: panel system acrylic, footwell lighting, down bias lighting, and arc lighting. Integrated control system shall incorporate a motion detector which will shut down all selected functions when workstation is unoccupied for fifteen (15) minutes. All previously selected functions will resume when motion detector senses movement in the workstation. Alternatively, components (up to 2) can be included and controlled via physical toggle switch.

Please feel free to contact me with any other questions, or if you need more detail.

Sincerely,
Kenneth R Carson

Attachment: March 2024 CM Update (5621 : City Manager's March 2024 Update) Illegal dumping is a regrettable crime that places the responsibility of cleanup on landowners. Even those who pay for dumpster services may discover others' waste in their bins, causing overflow and hindering their own disposal. Dumping bulky items around the dumpster adds to the challenge. Remember, it is unacceptable to dispose of waste in someone else's bin, even if it is in an open bin in a parking lot.

CODE COMPLIANCE
Landowners who have not registered their rental units are receiving citations. Contact code compliance to register your rental properties for 2023 and 2024 now. We appreciate those who have already complied.

All current cannabis applicants that have been approved by Council are have cleared their CEQA reviews. Out of the twenty-four cannabis business that have been approved by Council for the old Merchant Mall location, seven are operational (cultivation). Seven of the buildings are at the end of construction and have been issued Certificates of Occupancies. The remaining eighteen buildings at the location are still in their construction phase and will not be operations in the near future.

The cannabis mall site is currently working on compliance with the recent odor complaints.

Since being notified of the issue in December 2023, five of six businesses that were operating at that time have installed additional odor mitigation. The remaining company is underway on installation of additional odor mitigation as well. Odor complaints being received by the Cannabis Division has decreased significantly since December 2023.

PUBLIC WORKS DEPARTMENT
Park/Open Spaces
Thanks to hard work, the kiddie pool is now in better condition. The park staff dedicated efforts to address issues with the filtration system at Henderson Pool. They are troubleshooting the computer system that controls the pumps and sensors, as a part of the system is not dispensing the correct amount of chlorine to the main pool. To resolve this, staff members have been manually adjusting the chlorine levels until the matter is fixed by Knorr Pool Systems. Lucas has arranged for the company to inspect the issues and provide necessary training. Additionally, broken valve handles in the kiddie pool were discovered, and replacements have been ordered. Efforts are being made to meet the deadline of April 20, 2024, for Life Guard Certification.

The park staff is addressing the issue of weed growth in the city, which has flourished due to ideal weather conditions provided by Mother Nature. Since the herbicide previously used is no longer available, they will need to find an alternative product. Last month, the staff at Foglesong Park dedicated their efforts to preparing for the successful 2024 Annual Berlin Chile Cook-Off, which was well-received by the community. Staff is currently exploring quotes to level the clay baseball infields with a laser as there is a noticeable bump between the grass and the clay.

Attachment: March 2024 CM Update (5621 : City Manager's March 2024 Update) Fleet Maintenance had to adjust its operations schedule due to an error with an employee mistakenly filled equipment at the Sports Park with 25 gallons of fuel from Flyers Fuel Station. However, the staff were not trained on the correct fuel type and ended up using DEF (diesel emissions fluid) in the bunker rake and John Deere tractors, preventing the equipment from starting. The affected equipment was transported to the Corp. Yard to remove the DEF liquid from the fuel tanks and system, incurring costs for flushing the fuel system, draining the tanks, and labor for fluid removal. Thankfully, the Fleet staff managed to restore the equipment to proper working condition.
