REVIEW THE CITY’S MILITARY EQUIPMENT ANNUAL REPORT AND ADOPT RESOLUTION NO.

XXXX-2024 TO RENEW ORDINANCE NO. 989-2022, APPROVING THE CITY’S MILITARY EQUIPMENT POLICY, AS REQUIRED BY CALIFORNIA GOVERNMENT CODE SECTION 7070 EXECUTIVE SUMMARY:

Assembly Bill 481 (“AB 481”), codified in California Government Code Sections 7070 - 7075, requires law enforcement agencies to adopt a “military equipment” use procedure ordinance. The City adopted Ordinance No. 989-2022 on May 2, 2022 approving a “military equipment” use procedure. AB 481 requires the City to review the “military equipment” use procedure annually.

DISCUSSION:

On September 30, 2021, the Governor of the State of California approved Assembly Bill 481 (AB-481) requiring law enforcement agencies to obtain approval of the applicable governing body (City Council), by adoption of a “military equipment” use policy, as defined under AB 481. The Legislature found that the public has a right to know about any funding, acquisition, or use of “military equipment” by state or local government officials, as well as a right to participate in any government agency’s decision to fund, acquire, or use such equipment. “Military equipment” as governed by the proposed procedure is broader than just equipment received from the US military and generally includes all types of non-standard-issue firearms, including such things as less lethal munitions, e.g., rubber bullets, and remotely operated camera equipment. The proposed procedure adopts standards for the use and required training methods for these types of equipment.

On September 30, 2021, Governor Newsom signed into law Assembly Bill (AB) 481 which went into effect on January 1, 2022, and added California Government Code Sections 7070 through 7075 relating to the funding, acquisition, and use of military equipment by local law enforcement agencies. The bill required law enforcement agencies seeking to fund or acquire new military equipment or continue use of any military equipment acquired prior to January 1, 2022, to draft a military equipment use policy and obtain approval from its governing body via adoption of an ordinance no later than May 1, 2022.

On an annual basis thereafter, an agency is required to publish a military equipment report to its website and hold at least one community engagement meeting to allow the public to ask questions and discuss the report. The annual report shall include a summary of each type of military equipment, its intended purpose, how each type of equipment was used by the agency during the preceding year, a summary of any complaints received concerning the equipment, the results of any internal audits pertaining to violations of the military equipment use policy, the total cost for each type of equipment, and quantity possessed.

AB 481 further requires the governing body, at least annually, to review any ordinance that it has adopted approving the funding, acquisition, or use of military equipment and vote on whether to renew the ordinance. The City Council may renew or not renew the authorizing ordinance, disapprove authorization for equipment where standards have not been met, or require modifications to the military equipment use policy based on whether the equipment detailed within the annual report complies with policy and meets specified standards as set forth in California Government Code Section 7071, subdivision (d).

The Police Chief will present a report regarding Military Equipment in compliance with Assembly Bill 481, 6 Packet Pg. 43

AGENDA ITEM
including:
 How our military equipment was used;
 A summary or any complaints or concerns received;
 The result of an annual internal audit;
 Any information about violations of the military equipment policy and actions taken in response;  The total annual cost for each type of military equipment and the source of funds for the military equipment in the calendar year following submission of this annual military equipment report;  The quantity possessed; and
 Whether this agency intends to acquire additional military equipment in the next year.

Under Government Code section 7071, subdivision (e), the City Council shall review the Ordinance adopting the City’s Military Use Policy, Ordinance No. 989-2022, and vote to renew the Ordinance if it finds, based on the Annual Military Equipment Report, that the Military Use Policy continues to meet the findings stated therein; namely that:
 The military equipment is necessary because there is no reasonable alternative that can achieve the same objective of officer and civilian safety.
 The military equipment use policy will safeguard the public’s welfare, safety, civil rights, and civil liberties.
 If purchasing the equipment, the equipment is reasonably cost effective compared to available alternatives that can achieve the same objective of officer and civilian safety.  Prior military equipment use complied with the military equipment use policy that was in effect at the time, or if prior uses did not comply with the accompanying military equipment use policy, corrective action has been taken to remedy nonconforming uses and ensure future compliance.

If the City Council determines that a type of military equipment identified in that Annual Military Equipment Report has not complied with the standards for approval set forth above, the City Council shall either disapprove a renewal of the authorization for that type of military equipment or require modifications to the Military Equipment Use Policy in a manner that will resolve the lack of compliance.

Resolution No. XXXX-2024 is before the City Council and if adopted would renew Ordinance No. 989- 2022, which approved the Department’s military equipment funding, acquisition, and use policy pursuant to Assembly Bill 481.

FISCAL IMPACT:

There are no fiscal impacts at this time. The acquisition costs for most equipment covered by the proposed procedure have already been paid. The existing budget accounts for the costs of maintaining the equipment and of acquiring any needed new or replacement equipment.

Background
Assembly Bill 481 was adopted by the California Legislature and approved by Governor Gavin Newsom in September 2021. It went into effect on January 1, 2022. AB 481 is designed to increase community awareness and oversight over the possession and use by local police departments of certain types of equipment that AB 481 labels as “military” equipment. It requires the City Council to provide both authorization and oversight of the equipment used.

The law, codified in California Government Code sections 7070 through 7075, requires law enforcement agencies to produce a military equipment use policy that identifies and describes: each type of military equipment; its authorized use; fiscal impact; rules/laws that govern use of such equipment; training required; and mechanisms to ensure compliance with the policy. (See Gov. Code section 7070(d)). The City Council is required to approve the policy for the Department to continue using this equipment.

Additionally, the law requires an annual report and annual review by the governing body for continued use of the equipment. AB 481 requires every local law enforcement agency in California to post its proposed military equipment use policy no later than May 1, 2022. The law also requires at least a 30-day period for public comment on the proposed policy before the governing body discusses the proposed policy in a public meeting.

Police agencies across the state have developed similar policies to comply with this new law. The Department’s proposed policy describes the equipment that has already been in the Department’s possession. The Department does not possess any equipment that is atypical for the region.

The City of Richmond possesses fewer types of this equipment than many other Bay Area agencies.

COUNCIL AGENDA ITEM
AGENDA MATTER:

REQUEST FOR PUBLIC HEARING - DELINQUENT TRASH AND SEWER ACCOUNTS EXECUTIVE SUMMARY:

Staff requests that the City Council set the date, time, and place for the next delinquent sewer and trash (utility) accounts hearing for Monday, July 15, 2024, at 7:00 p.m. in the Council Chambers located at 220 E. Mountain View St., Barstow, CA 92311.

DISCUSSION:

The City of Barstow began billing for sewer and trash (utility) services in November 2020 for customers who receive trash services within the incorporated city limits and/or for those who are connected to the City's sewer system. Barstow Municipal Code (BMC) Sections 6.20.210 and 13.22.060 authorizes the periodic review of delinquent utility accounts. The code sections also authorizes the collection of delinquent amounts through the lien process, as well as constituting the delinquencies as a special assessment that can be assessed onto the property owner's tax bill.

Delinquent utility accounts are defined as those that have an unpaid (past due) balance after the delinquent (due) date. In order to properly notice those property owners who have a delinquent unpaid balance as of April 30, 2024, on their City of Barstow utility account, and pursuant to the BMC, staff is requesting the City Council establish the regularly scheduled meeting being held on Monday, July 15, 2024, at 7:00 p.m. in the City Council Chambers, located at 220 E. ADOPTION OF RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BARSTOW AUTHORIZING

THE INTERIM CITY MANAGER TO ENTER INTO A PROFESSIONAL SERVICES AGREEMENT FOR HEARING OFFICER SERVICES UNDER BARSTOW MUNICIPAL CODE CHAPTER 6.30 EXECUTIVE SUMMARY:

Staff recommends the Barstow City Council Adopt Resolution xxx-2024 authorizing the Interim City Manager to Enter Into a Professional Services Agreement for Hearing Officer Services Under Barstow Municipal Code Chapter 6.30.

DISCUSSION:

Chapter 6.30 of the Barstow Municipal Code provides each violation of a provision of the Barstow Municipal Code for which the penalty is an infraction or misdemeanor shall be subject to an administrative fine and penalty, in addition to and separate from any other remedy authorized by applicable law.

Appeals of administrative citations are allowed by any citation recipient. Under Barstow Municipal Code section 6.30.020, the hearing authority for administrative citation appeals is the code commission, if one exists, or if not, then the City Council. There is not currently a code commission.

Given the technical requirements per section 6.30.130 of the Barstow Municipal Code establishes procedures for hearings regarding administrative fines and penalties issued for violations of the Barstow Municipal Code and the nature of a contested code enforcement hearing, staff recommends the City Council exercise its inherent power to delegate its hearing officer selection role to the City Manager. If approved, the Interim City Manager would not sit as the hearing officer himself, but rather would enter into a professional services agreement with one or more hearing officers with professional expertise and capacity to hear administrative citation appeals. To ensure due process, the hearing officer would be appointed for a period of at least one year, per the Resolution’s sunset date. If more than one hearing officer is selected, then the hearing officers will hear appeals on a rotating basis. All hearings of administrative fine and penalty citations will be conducted per all requirements of applicable law and the Barstow Municipal Code, including Section 6.30.130.

CONSIDERATION OF THE RULES AND POLICY COMMITTEE COMPOSITION FOR THE PLANNING

COMMISSION POLICY AND ORDINANCE REVISIONS
EXECUTIVE SUMMARY:

The City Council is asked to consider changing the composition of membership on the Rules and Policy Committee temporarily for the Committee’s recommendation to the City Council regarding revisions to the Planning Commission’s rules for conduct of its meetings, proceedings, and business and its ordinance.

DISCUSSION:

At the May 20, 2024 meeting, the City Council asked for further consideration of the Rules and Policy Committee composition due to a potential conflict of interest with Councilmember Dyer-Kruse due to her husband’s pending permit application before the Planning Commission related to real property they own within the City. Pursuant to the City Council’s request, a memorandum analyzing Councilmember DyerKruse’s conflict of interest is attached to this staff report as Attachment 1.

As discussed in the memorandum, Councilmember Dyer-Kruse does not have a conflict of interest in decisions related to the Planning Commission’s policies and ordinance. Therefore, Councilmember DyerKruse does not have to recuse herself from participating on decisions related to the Planning Commission policies while her husband has a permit application pending before the Planning Commission. In its discretion, the City Council may change the membership of the Rules and Policy Committee at any time.

RE: Conflict of Interest Analysis - Rules and Policy Committee Review of Planning Commission Policies and Ordinance

INTRODUCTION AND BACKGROUND
The City Council established the Rules and Policies Committee on January 16, 2007 to recommend ordinance language, code revisions, and City policy as referred by the City Council or City Manager. The Committee is an advisory standing committee to the City Council. The Committee consists of two City Council members with technical support from City Manager staff. The Committee meets monthly and when considered necessary by staff. Committee members include Councilmember Barbara Rose and Councilmember Dyer-Kruse.

The Committee is tasked with reviewing rules for the conduct of Planning Commission meetings, proceedings, and business and the ordinance regulating the Planning Commission - Barstow Municipal Code Ch. 2.24 (“Planning Commission”).

You and your husband’s property, and the current location of your residence, were acquired by BNSF for the Barstow International Gateway (BIG) development. The BIG development is roughly a 4,500-acre new integrated rail facility on the west side of Barstow, consisting of a rail yard, intermodal facility and warehouses for transloading freight from international containers to domestic containers.

You bought vacant land adjacent to the BIG development. You plan to transport your house and personal property to the vacant land within the next year. While you await the transport of your house, you’ve arranged to rent-back your land and residence from BNSF. Included in your personal property are five transportation containers.

The containers were legally placed on at your current residence before the adoption of the BMC section 19.24.035, which established that transportation containers require a conditional use permit and are allowed only in certain zoning districts and subject to certain conditions.

On October 23, 2023, your husband sought a variance from the Planning Commission to place the five containers from your current residence at your new property zoned diverse use. A variance is needed because the BMC only allows transportation containers on commercial, industrial, and public facility zoned properties and your property is zoned diverse use. The variance was granted by the Planning Commission subject to several conditions, including that a conditional use permit for the containers was approved by the Planning Commission before the containers were placed on the vacant land.

On May 13, 2024 and May 28, 2024, the Planning Commission held hearings to consider approval of the relocation of the five transportation containers and constructing a 7,992 square foot accessory structure to house the containers. The Planning Commission continued the hearing to June 10th.

As discussed below, you do not have a material conflict that would prevent you from participating in a discussions or a decision by the Rules and Policy Committee to recommend changes to the Planning Commission’s policies and ordinance. So you do not have to recuse yourself from the Committee for these discussions.

You have a disqualifying conflict of interest in any appeal related to your husband’s permit application for the real property you own that may come before the City Council. If your husband appeals a Planning Commission decision, you must recuse yourself from participating in the hearing as a Councilmember.

POLITICAL REFORM ACT
Under the Political Reform Act, public officials shall not “make, participate in making or in any way attempt to use his official position to influence a governmental

decision in which he knows or has reason to know he has a financial interest.”1 A public official has a financial interest in a decision if it is reasonably foreseeable that the decision will have a material financial effect on a public official’s interests, or a member of the official’s immediate family, that is distinguishable from its effect of the public generally.2 The Act defines a public official’s “immediate family” as the official’s spouse and dependent children.3 One interest defined as having a material financial effect on an official’s interests is “any real property in which the public official has a direct or indirect investment worth two thousand dollars ($2,000) or more.”4 You have a financial interest in the vacant land you and your husband own. As your husband is seeking a conditional use permit for placing five transportation containers and an accessory structure on your vacant land, you have a disqualifying conflict of interest in any appeal that may come to the City Council regarding the conditional use permit. If your husband appeals a Planning Commission’s decision about permits for your property to the City Council, you must recuse yourself from the decision by announcing your conflict of interest on the record of the meeting and leaving the room before consideration of the item.

However, the question is whether you have a conflict of interest in decisions of Rules and Policies Committee to recommend changes to Planning Commission Resolution 467 and BMC Ch. 2.24.

NO FINANCIAL INTEREST IN DECISIONS OF THE COMMITTEE RELATED

TO THE PLANNING COMMISSION
The authority of the Committee is limited to making recommendations about ordinances language, code revisions and City policy to the full City Council. The Committee’s recommended changes to the Planning Commission’s policies and ordinance is limited to the conduct of Planning Commissioners and regulations that apply to the Planning Commission. The Committee is not changing policy related to permits approved by the Planning Commission or conditions placed on permits. So there is no foreseeable way the Committee’s decision on Planning Commission’s policies could materially affect your husband’s permit pending before the Commission. 1 Gov. Code, § 87100.
2 Gov. Code, § 87103.
3 Gov. Code, § 82029.
4 Gov. Code, § 87103, subd. (b).

360717.1
Even if the Committee’s recommendation was related to the City’s policies and ordinances related to conditional use permits, it would not apply retroactively to your husband’s application for a permit which is actively pending before the Planning Commission.

Further, a decision by the Committee to recommend policy on the Commission’s decisions about conditional use permits would likely fall within the “public generally exception” in the Political Reform Act. The public generally exception applies when a decision’s financial effect on an official’s financial interest does not differ from its effect on the pubic generally if the official shows that a “significant segment” of the public is affected and the “effect on the official’s interest is not unique” compared to the significant segment.5
A significant segment of the public is defined, in part, as at least 25 percent of all real property, commercial real property, or residential real property within the official’s jurisdiction6 or at least 15 percent of residential real property within the official's jurisdiction if the only interest an official has in the governmental decision is the official's primary residence.7
As a decision about the policies related to duties and conduct of the Planning Commission have no possibility of effecting your husband’s conditional use permit application pending before the Planning Commission, you do not have a financial interest in decisions of the Committee to recommend changes to the Planning Commission’s policies and ordinance. Thus, you need not recuse yourself from the Committee or participating in discussions or decisions about the Committee’s recommendation to the City Council regarding the Planning Commission Resolution 467 or BMC Ch. 2.24.

CONCLUSION
There are no facts to support that you have a disqualifying financial interest in decisions related to the Planning Commission’s policies and ordinance due to your husband’s pending permit application before the Planning Commission. So your do not have to recuse yourself from the Rules and Policies Committee for decisions related to the Planning Commission’s policies and ordinance.

APPROVAL OF AMENDED AND RESTATED LEGAL SERVICES AGREEMENT WITH

COLANTUONO, HIGHSMITH & WHATLEY, PC
EXECUTIVE SUMMARY:

The City of Barstow contracts for City Attorney Services with Colantuono, Highsmith & Whatley, PC, under a contract last amended in 2022. The Interim City Manager recommends the City Council approve a proposed amended and restated legal services agreement with Colantuono, Highsmith & Whatley, PC, maintaining current City Attorney Matthew Summers and adjusting the rates as stated therein.

DISCUSSION:

The law firm of Colantuono, Highsmith & Whatley, PC., and its predecessor firms and professionals have provided general legal services to the City of Barstow since 1997, with the contract most recently amended and rates last changed in 2022.

At this time, the Firm has proposed an amendment to the contract to adjust the rates to provide for a monthly fixed retainer amount of $10,935 and for special projects services at $245 per hour and labor and employment, litigation, and other pre-litigation disputes or specialized legal services at $310 per hour.

Appellate litigation services, if necessary, will be provided at $375 per hour. Work for the City to be reimbursed by others, such as developers, will be provided at $395 per hour, a higher rater allowing work completed at the City’s sole expense to be kept at lower rates. The agreement also provides for an annual inflationary adjustment per the consumer price index, but capped at 4%, and contingent on a positive annual performance evaluation of the firm and City Attorney by the City Council. All other substantive terms remain the same.

FISCAL IMPACT:

The cost of the proposed contract for legal services are accommodated with the existing budget.

RECOMMENDED ACTION:

The City Manager recommends the City Council approve a proposed amended and restated legal services agreement with Colantuono, Highsmith & Whatley, PC, maintaining current City Attorney Matthew Summers and adjusting the rates as stated therein. 10 Packet Pg. 77

Photocopies shall be billed at 15 cents per page, outgoing faxes will be charged at $1 per page. All other expenses will be billed at cost, without markup. The Firm will not charge for word-processing services or secretarial overtime. The Firm will make best efforts to avoid the use of outgoing faxes, and the costs associated with them, by use of email, U.S. Mail, and other means. These items will be separately designated on the Firm's monthly statements as "disbursements," and will be billed in addition to fees for professional services. The rate structure in general, or the rates of particular attorneys, may be increased or altered from time to time, after written notice to the City. To the extent feasible, such adjustments will be made so as to coincide with the beginning of the City's fiscal year.
c) The Firm will not charge the City for the time devoted to travel to and from the City's offices.

4. Resolution of Fee Disputes.

The City is entitled to require that any fee dispute be resolved by binding arbitration in San Bernardino County pursuant to the arbitration rules of the San Bernardino County Bar Association for legal fee disputes. In the event that City chooses not to utilize the San Bernardino County Bar Association's arbitration procedures, City agrees that all disputes regarding the professional services rendered or fees charged by the Firm shall be submitted to binding arbitration in San Bernardino County to be conducted by JAMS or another mediation service agreed upon by both parties in accordance with commercial arbitration rules.

Three years after termination of the attorney-client relationship, and after reasonable notice, the Firm will be free to destroy the City’s client file, including all electronic records. The Firm may also discharge its obligation to maintain the City’s file prior to the expiration of two years by mailing a copy to the City. “Reasonable notice” means the Firm’s mailing of a notice of our intent to destroy your client file to the City.

This Agreement contemplates the personal professional services of the Firm and this Agreement, or any portion thereof, shall not be assigned or delegated without the prior written consent of the City. Delegation to attorneys outside the Firm shall be limited to those situations in which the Firm is disqualified by virtue of a conflict of interest, or where the Firm does not possess the expertise to competently perform services in a particular practice area.

AGENDA MATTER:

COMMUNITY BENEFITS PROGRAM WORKSHOP DISCUSSION APPLICATION EXECUTIVE SUMMARY:

The City is hosting a workshop and encourages public engagement in the decision-making process. This includes identifying and prioritizing community needs and benefits, and choosing appropriate projects for funding by the Community Benefits Program.

DISCUSSION:

On November 8, 2016, the Control, Regulate, & Tax Adult Use of Marijuana Act (“AUMA”) was approved by California voters via Proposition 64. The AUMA permits local jurisdictions to regulate and/or ban adultuse cannabis cultivation, distribution and delivery, transportation, manufacturing, testing laboratories, dispensaries, and microbusiness facilities.

In June 2021, the City Council passed Ordinance No. 974-2021 which added Chapter 19.27 to the Barstow Municipal Code to permit commercial cannabis activities in the City. The ordinance went into effect on July 7, 2021. On October 4, 2021, the City Council adopted Ordinance No. 977-2021, amending the City’s cannabis regulatory program ordinance.

All cannabis businesses must enter into a development agreement with the City that will be subject to Council approval through the adoption of an ordinance under Government Code Section 65865. One of the terms of the development agreement requires the operator to coordinate and cooperate with the City, Operator, and/or any other Operators of commercial cannabis facilities located within the City in the establishment, implementation, and funding of a community benefits program which could include such items as senior citizen programs, City beautification efforts, funding for enforcement against illegal cannabis operations, public safety, housing programs, economic development, infrastructure, capital improvements, including expansion and/or improvement to existing facilities or other physical improvements that provide a benefit to the community, support of holiday and special community events, and support of local public service, public safety, litigation defense, and special social and community organizations. This community benefits program will be implemented by the City.
