RESOLUTION NO. XXXX-2024
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BARSTOW
DECLARING ITS INTENTION TO AUTHORIZE THE LEVY OF
ASSESSMENTS UPON CERTAIN PARCELS OF REAL PROPERTY
WITHIN FLOOD CONTROL MAINTENANCE DISTRICT NO. 1,
LANDSCAPE MAINTENANCE DISTRICT NO. 1, STREET
MAINTENANCE DISTRICT NO. 1, AND STREET LIGHTING DISTRICT NO. 1
WHEREAS, the City Council of the City of Barstow wishes to provide continued financing for necessary maintenance of certain public improvements within the Street Lighting, Flood Control, Landscaping, and Street Maintenance Districts # 1 through a levy of benefit assessments for the fiscal year 2024-2025 under the provisions of the Landscaping and Lighting Act of 1972 (Streets and Highway Code Section 22500 et seq.) and the Benefit Assessment Act of 1982 (Government Code Section 54703 et seq.), and
WHEREAS, the City Council therefore proposes to levy benefit assessments pursuant to the provisions of the Benefit Assessment Act of 1982 Act and the Landscaping and Lighting Act of 1972, to insure continued financing of the necessary maintenance of certain Street Lighting, Flood Control and Drainage Improvements, Landscaping, and Street Improvements.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BARSTOW HEREBY FINDS DETERMINES, ORDERS AND RESOLVES AS FOLLOWS:
1. That the public interest, convenience and necessity require the continued maintenance and operation of the public street, street lighting, sidewalks, flood control, landscape and drainage improvements for the direct benefit of the properties within the Districts.
2. The area of benefit shall be all lands in the City of Barstow within the boundaries shown on the maps of Street Lighting, Flood Control, Landscaping and Street Maintenance District #1, as are on file in the Office of the City Clerk of the City of Barstow.
3. That the proposed improvements with respect to each of the Districts may be briefly described as follows:
With respect to the Street Maintenance District: the operation and maintenance of public streets and sidewalks within said district, including sweeping, striping, signing, crack filling, and other pavement maintenance;
With respect to the Landscape Maintenance District: the maintenance and Resolution No. XXXX-2024
servicing of landscaping located in public roadways, streets, andright-ofway within said district; With respect to the Flood Control Maintenance District: the operation and maintenance of drainage and flood control system in connection with said district, including open channels, storm drains, inlets and debris basins.
With respect to the Street Lighting District: the operation of street lighting in connection with said district including the public roadways, streets, and right-of- way within said district.
4. That the Consulting City Engineer as the “Engineer of Work” is hereby ordered to have the Engineer’s Report prepared for the fiscal year 2024-2025 in accordance with the law.
5. That the time and place for the hearing by the City Council on the Engineer’s Report and the determination of the proposed assessments is hereby set for August 5, 2024 at 7:00 p.m. in the City Council Chambers, 220 East Mountain View Street, Barstow, California.
6. The City Clerk is hereby directed to publish notice of the public hearing in the Desert Dispatch, a local newspaper of general circulation within the area of benefit.
