Re: Application for Closure of Midway Mobilehome Park 24644 (3727)' West Main St., Barstow, CA
Thank you for your application dated May 30, 2024 to close the Mobile Home Park at 24644 (3727) West Main Street Barstow, CA 92311. We understand from your correspondence that no residents or mobilehome owners have been on the site since prior to November 2023, and none current exist on site.
We are required pursuant to Government Code section 65863.8(a) to notify you of the provisions of Civil Code section 798.56, and any local regulations concerning the duty to notify residents and mobilehome owners of the proposed change of use. No local regulations exist regarding mobilehome park closure. The provisions of Civil Code section 798.56 are attached hereto.
We are also required to specify the manner in which you shall verify that residents and mobilehome owners have been notified of the proposed change in use. Ordinarily we would have required you provide a copy of the correspondence you provided to each resident or mobilehome owner transmitting the report required in Government Code section 65863.7(a) to fulfill the requirements under Government Code section 65863.7(c) and Civil Code section 798.56(g). However, because no residents or mobilehome owners have been on site since November 2023, no further notice is required under this situation since no residents or mobilehome owners are presently on site.
Therefore, the City of Barstow can verify that pursuant to Government Code section 65863.8(a) that the requirements to notify park residents and mobilehome owners has been complied with in accordance with prescribed law.
