COUNCIL ORDINANCE
AGENDA MATTER:
SECOND READING OF ORDINANCE NO. 1024-2024 OF THE CITY OF BARSTOW AMENDING CHAPTER 2.24 REGARDING THE PLANNING COMMISSION
EXECUTIVE SUMMARY:
The City Council asked the Rules and Policy Committee to review the ordinance and resolution regulating the absences of Planning Commissioners. After receiving feedback from the public, the City Clerk, the City Attorney’s Office and the Chair of the Planning Commission, the Rules and Policy Committee recommends several changes to the ordinance and resolution regulating the conduct of Planning Commissioners and Planning Commission meetings.
At the July 15, 2024, the Rules and Policies Committee introduced their recommended changes to the Planning Commission’s policies to the City Council via Ordinance No. 1024-2024 amending Barstow Municipal Code Chapter 2.24 (Planning Commission) and Resolution No. 5174-2024 amending the Rules for the Conduct of Planning Commission Meetings. Resolution No. 5174-2024 was adopted by the City Council on July 15, 2024. The ordinance is presented for its second reading and adoption.
DISCUSSION:
On December 18, 2023, the City Council requested the Rules and Policy Committee (Committee) to propose an attendance policy for the Planning Commission (Commission). The Rules and Policy Committee meet several times regarding the regulations of the Commission, and has received input from the public, the City Clerk, the City Attorney’s Office and the Commission Chair about the Commission’s policies. Enclosed are Committee’s recommended changes to the Planning Commission’s ordinance and resolution, which take into account such feedback.
The major changes to the Barstow Municipal Code Chapter 2.24 (Planning Commission) for review by the City Council, include:
Section 2.24.020 - Term. Commissioners can serve until their successors are appointed and qualified. Commissioners may apply to be reappointed at their end of their term. Requiring Commissioners to apply for reappointment ensures all community members have an equal opportunity to participate in the process to fill a vacancy. Section 2.24.035 - Appointment and reappointment procedures. Removes ability of the City Council to fill a vacancy without a competitive process. Unless there is an unscheduled vacancy that requires appointment, the City Council must be notified of a vacancy. 7 Packet Pg. 15

All recommended appointments must be confirmed by a majority of the City Council.
Section 2.24.050 - Meeting notice. Updated to align with policy in the Planning Commission’s resolution regarding Commission meeting cancellations.
Section 2.24.070 - Procedures. Removes the ability of the Commission to adopt their own regulations. Commission procedures must be prescribed by law, ordinance, or a City Council resolution.
Attachment 1 - Ordinance amending Ch. 2.24 (Planning Commission) Note - the Ordinance shows the additions and subtractions directly in its text.
FISCAL IMPACT:

AGENDA MATTER:
FY 2024-2025 PUBLICLY AVAILABLE PAY SCHEDULE (PAPS) FOR FY 2024-2025 BUDGETED POSITIONS AND FY 2024-2025 NEWLY ADDED POSITIONS
EXECUTIVE SUMMARY:
The City of Barstow's governing body must approve a publicly available pay schedule (PAPS) in order to comply with the requirements of the California Public Employees' Retirement System (CalPERS) and the California Code of Regulations (CCR), Section 507.5.
DISCUSSION:
The California Public Employees' Retirement System (CalPERS), pursuant to California Code of Regulations Section 570.5, requires that CalPERS employers maintain a publicly available pay schedule (PAPS) that meets all of the following requirements:
1. Has been duly approved and adopted by the employer’s governing body in accordance with requirements of applicable public meetings laws;
2. Identifies the position title for every employee position;
3. Shows the pay rate for each identified positions, which may be stated as a single amount or as multiple amounts within a range;
4. Indicates the time base, including, but not limited to, whether the time base is hourly, daily, biweekly, monthly, bi-monthly, or annually;
5. Is posted at the office of the employer or immediately accessible and available for public review from the employer during normal business hours or posted on the employer’s internet website;
6. Indicates an effective date and date of any revisions;
7. Is retained by the employer and available for public inspection for not less than five years; and
8. Does not reference another document in lieu of disclosing the pay rate.
The PAPS is available on the City of Barstow's website. The PAPS will be brought before the City Council any time a revision or modification is required. The FY 24/25 PAPS being presented to the City Council for approval is compliant with the aforementioned requirements of CalPERS and will become retroactively effective on July 1, 2024. The PAPS also includes the positions that were approved in FY 2024-2025 as part of the Animal Services Division which includes an Animal Services Manager, Animal Control Officers, and Kennel Technicians.
FISCAL IMPACT:
None, as positions are budgeted through the FY 25 budget process or by subsequent City Council action.
The recommended action is adoption of the publicly available pay schedule that complies with requirement of the California Public Employee's Retirement System (CalPERS) and the California Code of Regulations (CCR), Section 507.5.

COUNCIL RESOLUTION
AGENDA MATTER:
ANNUAL RENEWAL AND REAFFIRMATION OF ASSESSMENT DISTRICT #1 FOR FISCAL YEAR 2024-2025
EXECUTIVE SUMMARY:
Annually, the City must reaffirm the active assessment districts located within Barstow. To comply with this requirement, staff recommends that the City Council approve Resolution No. ____-2024 (Attachment A) adopting the continuation of the levying of the assessment district. It is important to note that staff is recommending no adjustment to the existing assessment levels.
DISCUSSION:
In 1988 and 1990, four benefit assessment districts were established to fund services in newly developed areas of the City. Each year, the City must certify and adopt an updated Engineer’s Report to continue levying the assessment district fees. An overview of each of the four assessment districts includes the following:

On July 1, 2024, the City Council approved Resolution No. 5171-2024 to initiate proceedings to reaffirm the levy and collection of annual assessments for Fiscal Year 2024/25. AGENDA MATTER:
ADOPT RESOLUTION NO. ____-2024, TO QUITCLAIM THE WEST BARSTOW SUBSTATION
PARCEL TO SOUTHERN CALIFORNIA EDISON
EXECUTIVE SUMMARY:
The City and Southern California Edison dispute which party is the owner of the land underneath the West Barstow Substation (APN No. 0182-212-08). The City does not believe it has ownership of the parcel pursuant to various title and legal sources, but Southern California Edison believes the City owns the parcel. Therefore, to clear up any possible confusion regarding title to the land underneath the West Barstow Substation, the City Attorney’s Office recommends the City quitclaims the parcel to Southern California Edison.
DISCUSSION:
The City and Southern California Edison dispute which party is the owner of the land underneath the West Barstow Substation (APN No. 0182-212-08). The City has no need to own the land, nor does it believe it has ownership of the parcel pursuant to information from the San Bernardino County Clerk’s Office, as well as a title report prepared for Southern California Edison by Commonwealth, which indicates that the Substation is on property owned by Southern California Edison along with reports from CoreLogic and MLS Tax Suite, which come to the same conclusion. Despite the information provided, Southern California Edison believes the City owns the land underneath the West Barstow Substation.
In order to resolve the dispute and to clear up any possible confusion regarding title to the parcel, the City Attorney’s Office recommends the City quitclaim the parcel to Southern California Edison.

Message from Andrew Espinoza, Jr., Interim City Manager JUNE 2024 CITY MANAGER UPDATE
Barstow Mayor Pro Tem James Noble, Councilmember Carmen Hernandez, Councilmember Barbara Rose, Interim City Manager Andrew Espinoza Jr., and Assistant City Manager Kody Tompkins attended a ribbon-cutting ceremony at Lillian Park to unveil its recent improvements and renovations. The enhancements at Lillian Park were funded through a partnership between the City of Barstow and the United States Army under the Intergovernmental Support Agreement (IGSA).
The City of Barstow extends its gratitude to Colonel Lane A Bomar and the United States Army for their support and belief in the Barstow community.
The City of Barstow and Ft. Irwin recently
established a groundbreaking 10-year
contractual agreement, referred to as IGSA
(Intergovernmental Services Agreement), on
June 10th. This agreement aims to offer
base operation support services for soldiers
at Ft. Irwin and the surrounding community.
By overseeing IGSA administratively, the City
is set to drive local economic growth and
enhance its general fund to support citywide
services. Cheers to both partners on this
significant achievement.

RECREATION
All approved cannabis applicants endorsed by the Council have successfully completed their CEQA evaluations. Staff members are collaborating with the Air Quality Management District to assist applicants in securing the necessary permits from the agency. Inspections will be carried out with the coordination of AQMD, BPD, Building Department, and the Cannabis Division before projects receive final approval to open. Presently, two retail locations are fully compliant and operational. In addition, two more retail spaces are undergoing plan reviews, while two are currently under construction. Out of the twenty-four cannabis businesses approved by the Council for the former Merchant Mall site, seven are operational for cultivation. Seven buildings have reached the completion stage and have been granted Certificates of Occupancy. The remaining eighteen buildings at the site are still in the construction phase and will not be operational in the near term.
Efforts are underway at the cannabis mall site to address recent odor complaints. Since the matter was brought to light in December 2023, five out of the six businesses operating at the time have implemented additional odor control measures. The remaining business is in progress with implementing additional odor control as well. The number of odor complaints received by the Cannabis Division has significantly decreased since December 2023.

On June 17th, the Council approved a new three-year laboratory agreement for Babcock Labs.
This agreement will ensure compliance with State Water Board regulations by carrying out mandatory sampling and analysis procedures.
The staff removed the bypass pipe that was skirting the grit chamber, reattaching it to the newly epoxied grit chamber. While the grit chamber was bypassed, the staff used a Vactor truck to clean the 21-inch discharge line, removing around 30 cubic feet of grit, gravel, and rocks. This cleaning process is expected to significantly enhance influent pumping efficiency.
Before reconnecting to the system, the staff took the opportunity to replace a 30-year-old influent flow meter, along with installing new wiring for it. Additionally, 60 feet of 3x3 corrosive L-angle was replaced with new stainless steel to support the top catwalk area.
Waste Water Updates
Amidst the intense heat, the fleet staff is diligently handling repairs, services, and inspections to ensure all vehicles and equipment have fully operational air conditioning systems. Their priority is to guarantee that the staff can perform effectively in their respective roles.
