RE: Statement of Abatement Costs
Real Property:
San Bernardino County Assessor Parcel Nos. 0181-247-04-0000 City personnel by ACC, Inc. (its agent) entered the above-referenced property on February 7, 10, and 13, 2025 between 8:00 a.m. and 6:00 p.m.) and in the morning of February 6, 2025, pursuant to an Abatement Warrant that Judge Rasheed S. Alexander of the San Bernardino County Superior Court (Victorville District) issued on February 6, 2025, and completed the following nuisance abatement actions:
• All debris resulting from a fire (including inside or exterior to the residence) was removed and disposed of.
• Plywood barriers of at least ½ inch in thickness were installed over all openings of the residence (including but not limited to all windows and doors). • All combustible materials inside of a shed structure in the rear yard were removed and disposed of. Plywood barriers of at least ½ in in thickness were installed over all openings of that structure.
• All combustible or other material/items including but not limited to junk, trash, and debris, in the front, side, and rear yards were removed and disposed of. • All weeds, drybrush, and/or dead/decayed/diseased/overgrown vegetation in the front, side, and rear yards, and in the parkway, were cut/removed and disposed of.

The city's abatement costs total $27,749.50 (see accounting in the attached Appendix to this letter). You are required to tender this sum in full to the city within thirty (30) days of the date of service of this statement unless the City Clerk's Office (located at 220 E. Mt. View St., Suite A, Barstow, CA 92311) receives your written request for contesting this statement within ten (10) calendar days of service. The written request shall include the following information:
1. Name, address, telephone number and signature of each responsible party who is contesting the Statement of Abatement Costs.
2. Address and description of the real property upon which the City abated a public nuisance.
3. Date of the statement of abatement costs being appealed/contested.
4. Description of the specific abatement costs being contested and a statement of the grounds for contest in sufficient detail to enable the City Council to understand the nature of controversy.
Please be further informed as follows:
Failure of the City Clerk to receive a timely request for contest constitutes a waiver of the right to contest this statement of abatement costs. In this event, the statement of abatement costs is final and binding, and the city may proceed to collect its abatement costs as stated herein in any manner allowed by law, which includes a special assessment or a nuisance abatement lien against the property.
If a timely request for contest is received by the City Clerk, a hearing shall be set before the city council no later than 60 calendar days, and no sooner than ten calendar days, of receipt. A notice of the date, time and location of the hearing shall be served on all responsible parties who contested the statement of abatement costs by first class mail to the addresses stated on the request form at least ten calendar days prior to the hearing.
Failure of a person requesting a contest to receive a properly addressed notice shall not invalidate any action or proceeding by the city pursuant to this chapter. • Any request by an appellant to continue a hearing must be submitted to the City Clerk in writing no later than five business days before the date scheduled for the hearing. The city council may continue a hearing for good cause; however, in no event may the hearing be continued for more than 45 calendar days without stipulation by all parties. • At the time and place fixed for receiving and considering the request to contest the statement of abatement costs, the city council shall hear and pass upon the evidence submitted by city personnel, together with any objections or protests raised by responsible persons liable for said costs. Thereupon, the city council may make such revision, correction or modification to the statement as it may deem just, after which the statement, as it is submitted, or as revised, corrected or modified, shall be confirmed. The hearing may be continued from time to time for good cause. The decision of the city council is final.
