AGENDA ITEM
AGENDA MATTER:

SECOND READING AND ADOPTION OF ORDINANCE #1033-2025 OF THE CITY OF BARSTOW AMENDING SECTIONS 9.45.030 AND 9.45.060 TO REQUIRE TEMPORARY USE PERMITS FOR

EVENTS SERVING ALCOHOL ON CITY PROPERTY OR FACILITIES
EXECUTIVE SUMMARY:

The proposed ordinance requires the organizers of an event on City property, facilities, or public rights-ofway to apply for a temporary use permit if alcohol will be served and consumed at the event.

At it’s May 27, 2025 meeting the Barstow Rules and Policy Committee considered this ordinance and recommended adoption with no changes. On July 1, 2025, the City Council received public comment on the matter, and considered the administrative report. This ordinance is now before the Council for adoption.

DISCUSSION:

This ordinance would amend section 9.45.030 of Chapter 9.45 of the Barstow Municipal Code titled “Temporary Uses” to add a subdivision (4) that would require all events on city property, city facilities, and public rights-of-way to apply for a temporary use permit, if alcohol is to be served and consumed at the event. The requirement to apply for a temporary use permit would apply regardless of the zoning or district of the city property, facility, or public right-of-way. The purpose of this amendment is to codify into the Municipal Code what has been the standard practice of the City.

This ordinance would also amend section 9.45.060 of Chapter 9.45 to add a subdivision (15) that would require that for events where alcohol is to be served and consumed that the applicants comply with the following conditions:
(1) Obtain a license from the Bureau of Alcoholic Beverage Control to serve alcohol at the event; (2) Submit event plans and licenses to the City Manager for review; (3) Obtain liquor liability insurance. The coverage under the policy would be determined by the City Manager based on factors, such as the type of event, the amount of alcohol to be served, and the overall risk of damage to City property, facilities, or the public; (4) Confer with the Chief of Police to provide security for the event, or submit documentation proving alternative means of providing security at the event; and (5) Comply with all other laws and regulations applicable to the event and any other conditions imposed within the discretion of the City Manager.

The purpose of these conditions is to provide the City more control over how City property, facilities, and public rights-of-way serve alcohol, and to ensure alcohol is served in compliance with all applicable laws and regulations. The final condition further allows the City Manager to tailor conditions specifically to the event if further conditions are necessary to protect City property, facility, and public rights-of-way. 8 Packet Pg. 238

COUNCIL AGENDA ITEM
AGENDA MATTER:

RESOLUTION TO ADOPT PROJECTS FUNDED BY SENATE BILL 1 (SB 1), THE ROAD REPAIR AND ACCOUNTABILITY ACT OF 2017, FOR FY 2025-2026
EXECUTIVE SUMMARY:

In order to be eligible for transportation funding under Senate Bill 1 (SB1), the Road Repair and Accountability Act of 2017, the City is required to adopt a project list annually by resolution.

DISCUSSION:

On April 28, 2017, the Governor signed Senate Bill 1 (SB1) which is known as the Road Repair and Accountability Act of 2017. By increasing per gallon fuel excise taxes, increasing diesel fuel sales taxes, and vehicle registration fees with inflationary adjustments to tax rates in future years, SB 1 will fund necessary road maintenance, rehabilitation, and critical safety needs on both the state highway and local roadway systems.

Beginning November 1, 2017, the State Controller began depositing various portions of funding into the Road Maintenance and Rehabilitation Account (RMRA). Each fiscal year, eligible cities and counties receive an apportionment of RMRA funds pursuant to State Highway Code 2032(h)(2) from the California Transportation Commission (Commission). The State Controller continuously apportions RMRA funds on a monthly basis to eligible cities and counties using a process and system similar to that of the Highway Users Tax Account (HUTA).

The RMRA receives funding from taxes imposed under the Road Repair and Accountability Act of 2017.

RMRA local streets and road allocations must be used for projects “that include, but are not limited to,” the following:

Road Maintenance and Rehabilitation
 Safety Projects
 Railroad Grade Separations
 Traffic Control Devices
 Complete Street Components
o To include active transportation purposes, pedestrian and bicycle safety project, transit facilities, and drainage and storm-water capture project in conjunction with any other allowable project.

RMRA funds may also be used to satisfy match requirements in order to obtain state or federal funds for eligible projects.

SB1 also contains non-obligatory intent language regarding the use of funds. “To the extent possible and cost-effective,” cities and counties are to use:

 Resiliency (e.g. climate change, fires, floods, sea level rise);and  Complete street elements, access for bicycles, andpedestrians.

If a city or county has an average Pavement Condition Index (PCI) that meets or exceeds 80, the city or county may spend its RMRA funds on transportation priorities other than these.

FISCAL IMPACT:

None as part of this agenda item. This agenda item only identifies potential projects that meet the requirements and guidelines for use of SB1 funding. All projects will be approved via the budgeting, fiscal year carryforward, or capital improvement project (CIP) bidding process.

COUNCIL AGENDA ITEM
AGENDA MATTER:

ADOPTION OF RESOLUTION NO. 5236-2025 - INTENTION TO DISESTABLISH PUBLIC IMPROVEMENT DISTRICT 83-1
EXECUTIVE SUMMARY:

The City Council established Public Improvement District 83-1 on March 19, 1985, to provide sewerage facilities to areas of West Barstow. Given that the facilities have now been constructed, the District is no longer necessary and should be dissolved. The first step is to adopt a Resolution of Intention to Disestablish the District and the matter will then return to the City Council at the August 19, 2025 meeting for further action.

DISCUSSION:

On January 21, 1985, the City Council adopted Resolution No. 2679-85, declaring its intention to form a public improvement district. Thereafter, on March 18, 1985, by adoption of Resolution No. 2689-85, the City Council created Public Improvement District 83-1 (the “District”) pursuant to the Municipal Improvement Act of 1913 and ordered assessments against the approximate 1,376 parcels within the District’s boundaries. The District assessed landowners in West Barstow for related costs of providing the sewerage improvements, appurtenances, and appurtenant work. On April 22, 1985, by Resolution No. 2702-85, the City Council authorized the issuance of bonds to represent and be secured by certain unpaid assessments. Since its inception, staff has diligently used the funds provided by the assessments to construct the anticipated sewer line, identified by three sections: Lenwood Interceptor, Sun ‘N Sky Interceptor, and the Lenwood Road Interceptor. Given the District has constructed the required facilities, has no outstanding debts, and no remaining funds, it is appropriate to dissolve the District.

This matter was originally brought to the City Council on May 20, 2025. Councilmember Hernandez expressed concerns regarding an approximate $750,000 payment that the City made to cover delinquencies in the account and sought additional information. The City Council then pulled the item and staff performed additional research.

Between 1993-2002, the City provided approximately $757,000 from the General Fund to fund PID-83 due to delinquencies. Due to payments from the County, in 2006, the City confirmed that all but approximately $210,000 was paid back. In 2005, the City sent a letter to the County auditor/tax collector asking that the County include the remaining delinquent parcels in the next tax sale. Based on the newest information the City has obtained, it appears that the balance of delinquencies is down to less than two hundred dollars.

The City Council must first pass a resolution of intention to disestablish the District, which is attached as Exhibit A. Then, the resolution will be published and sent to affected property owners. The matter will return to the City Council at the August 19, 2025 meeting, where the Council can hear from any members from the public as to the proposed dissolution. The City Council will then have the opportunity to vote to disestablish the District via resolution. The resolution will then be recorded against the properties within the District.

COUNCIL AGENDA ITEM
AGENDA MATTER:

AMENDMENT TO PROFESSIONAL SERVICES AGREEMENT WITH PLACEWORKS, INC. FOR CONSULTANT SERVICES, IN THE AMOUNT OF $327,435, ASSOCIATED WITH THE GENERAL

PLAN UPDATE
EXECUTIVE SUMMARY:

In October 2022, staff brought forward a Professional Services Agreement for consulting services with PlaceWorks, Inc in order to retain their agency to assist in the completion of the City’s mandated General Plan Update (GPU) and associated Environmental Impact Report (EIR). Since the approval of that Professional Services Agreement, City staff and PlaceWorks have been diligently working to complete the comprehensive General Plan update, including the associated Barstow International Gateway Specific Plan (BIG SP), the Environmental Impact Report (EIR), conduct public outreach, and coordinate with outside agencies required to complete the update.

To supplement the original budget and to obtain additional support, staff is requesting this amendment to increase the contract amount from $1,786,251 to $2,113,686, to allow for additional tasks related to GIS, outreach, the General Plan document, EIR, and tasks related to fiscal analysis, legal compliance, and peer review/EIR integration.

DISCUSSION:

Please see Executive Summary.

FISCAL IMPACT:

The City adopted the fiscal year budget 2025/2026 and budgeted accordingly to cover the remaining amount owed to the consultant. Additionally, as noted, BNSF will reimburse $283,000 of the requested $327,435.

RECOMMENDED ACTION:

Staff recommends:

1. Approval of the Professional Services Agreement Amendment with PlaceWorks (Attachment A) for the General Plan Update and associated tasks, in the amount of $327,435, of which $283,000 is reimbursable leaving a fiscal impact of $44,435 which is available in the adopted FY2025-26 budget; and

2. Approval of Resolution 5237-2025 (Attachment B), increasing offsetting revenues and expenditures in the amount of $283,000.

Subject: City of Barstow General Plan Update – Scope and Budget Augment Dear Mr. Heldreth,
As the City continues to process the BIG Specific Plan and integrate the environmental analysis into the General Plan Update and EIR (GPU), the ongoing coordination, reconciliation, and refinements to the project have led to a marked increase in time spent on communications, technical analysis, and revisions to ensure an outcome that is legally defensible and supported by the community.

The notable changes include the integration of a pending County project (in the Lenwood community) into the cumulative analysis and some minor adjustments by BNSF to the project figures for BIG. The pending County project was originally going to be treated primarily in a qualitative manner, but the collective decision was made to intensify the level of coordination (with the County, BNSF, and service providers) and consideration given to the potential implications for the BIG project and overall General Plan Update. The minor adjustments BNSF made to the project figures, while they are few in number and do not materially change the nature of the project, need to be reflected throughout the entire EIR in a consistent manner to ensure legal defensibility.

The primary reason for the budget augment request is the ever-growing complexity of preparing a programmatic EIR analysis for the General Plan Update and a project EIR analysis for the BIG project. In particular, a substantial amount of time has been spent and will continue to be spent coordinating with BNSF and their consultant team to understand and reconcile approaches, methodologies, thresholds, alternatives, and significance findings. There is additional time projected for coordination meetings related to annexation, prezoning, staff reports, and supporting materials for the entitlement of the BIG project.

Finally, in order to maintain schedule and progress on the Draft EIR, and after consultation with City staff, PlaceWorks billed time for work on the Draft EIR (Task 5.5) to the task associated with the Final EIR and Response to Comments (Task 5.6). Accordingly, time and budget spent in May 2025 on Task 5.6 needs to be replaced in order to have adequate time and budget to prepare the Final EIR and response to comments.

While our team endeavored to accommodate the ongoing project refinements and additional coordination and revisions within the currently approved budget, it became clear in April 2025 that additional time would be needed to complete the effort. This includes GIS, the General Plan, zoning, environmental analyses, and project coordination. Based on communications with City, PlaceWorks is submitting the following request for an augment. Fortunately, there was adequate budget remaining as currently approved to enable PlaceWorks to proceed with work to maintain progress on the BIG SP and GPU effort.

Packet Pg. 296 Attachment: Attachment A - July 2025 Amendment (6039 : Amendment to Professional Services Agreement with PlaceWorks Inc.) Budget Augment Request June 23, 2025 | Page 2
SCOPE OF WORK – AUGMENT REQUESTED BY TASK
Task 1.3 GIS Data and Mapping: Additional GIS data and mapping to address changes to General Plan maps based upon the draft BIG Specific Plan and revised maps to support the EIR and annexation materials.

Task 3.3 Final General Plan: Revisions to the 2048 projections approach and methodology, SB 330 compliance, land use and circulation plans, and draft policies and implementation.

Task 3.4 Fiscal Analysis: Removal of this task based upon the work prepared by other consultants under separate contract to the City. The budget for this task would be reallocated to Task 3.3 to address additional changes to the General Plan document throughout the remainder of the update process.

Task 4.2 Zoning Consistency: Additional assistance to provide further assistance to the City on changes to the Zoning Map and Zoning Code text, in support of General Plan implementation and annexation materials.
