AGENDA MATTER:
SECOND READING AND ADOPTION OF ORDINANCE #1033-2025 OF THE CITY OF BARSTOW AMENDING SECTIONS 9.45.030 AND 9.45.060 TO REQUIRE TEMPORARY USE PERMITS FOR
EVENTS SERVING ALCOHOL ON CITY PROPERTY OR FACILITIES
EXECUTIVE SUMMARY:
The proposed ordinance requires the organizers of an event on City property, facilities, or public rights-ofway to apply for a temporary use permit if alcohol will be served and consumed at the event.
At it’s May 27, 2025 meeting the Barstow Rules and Policy Committee considered this ordinance and recommended adoption with no changes. On July 1, 2025, the City Council received public comment on the matter, and considered the administrative report. This ordinance is now before the Council for adoption.
DISCUSSION:
This ordinance would amend section 9.45.030 of Chapter 9.45 of the Barstow Municipal Code titled “Temporary Uses” to add a subdivision (4) that would require all events on city property, city facilities, and public rights-of-way to apply for a temporary use permit, if alcohol is to be served and consumed at the event. The requirement to apply for a temporary use permit would apply regardless of the zoning or district of the city property, facility, or public right-of-way. The purpose of this amendment is to codify into the Municipal Code what has been the standard practice of the City.
This ordinance would also amend section 9.45.060 of Chapter 9.45 to add a subdivision (15) that would require that for events where alcohol is to be served and consumed that the applicants comply with the following conditions:
(1) Obtain a license from the Bureau of Alcoholic Beverage Control to serve alcohol at the event; (2) Submit event plans and licenses to the City Manager for review; (3) Obtain liquor liability insurance. The coverage under the policy would be determined by the City Manager based on factors, such as the type of event, the amount of alcohol to be served, and the overall risk of damage to City property, facilities, or the public; (4) Confer with the Chief of Police to provide security for the event, or submit documentation proving alternative means of providing security at the event; and (5) Comply with all other laws and regulations applicable to the event and any other conditions imposed within the discretion of the City Manager.
The purpose of these conditions is to provide the City more control over how City property, facilities, and public rights-of-way serve alcohol, and to ensure alcohol is served in compliance with all applicable laws and regulations. The final condition further allows the City Manager to tailor conditions specifically to the event if further conditions are necessary to protect City property, facility, and public rights-of-way.
