Commercial Cannabis Business Development Agreement
Greetings:
As you know, on February 5, 2025 the City of Barstow (“City”) sent you a notice of breach (“Notice of Breach”) informing you that you were in breach of your Commercial Cannabis Business Development Agreement (“Development Agreement”) because you failed to pay certain amounts to the City as and when due under the Development Agreement, Barstow City Council Resolution(s), and/or the Barstow Municipal Code.
The Notice of Breach provided you with 35 days within which to cure the breach by paying the outstanding amounts to the City. As of the date of this notice, you have failed to cure the breaches set forth in the Notice of Breach, of copy of which is enclosed for reference.
YOU ARE HEREBY NOTIFIED pursuant to Barstow Municipal Code section 19.46.050(b) that the City intends to terminate and cancel the Development Agreement in its entirety.
YOU ARE FURTHER NOTIFIED that the City Council will hold a public hearing to consider whether to terminate and cancel the Development Agreement at the following date, time, and location:

Subsequent notice of the foregoing public hearing will be given by the City in accordance with Barstow Municipal Code sections 19.46.030 and 19.40.010.
If the City terminates the Development Agreement, the City shall retain any and all benefits, including, without limitation, money or land received by the City, under the Development Agreement, as provided in section 15.e. of the Development Agreement.
